737.11 PURCHASES PROHIBITED.

   (a)   No licensee shall purchase or receive any scrap metal article or material from any person between the hours of 7:00 pm and 7:00 am.

   (b)    No licensee shall purchase or receive any scrap metal article or material from any person under the age of eighteen (18), or from any person identified either in writing or electronic format to the licensee by the Chief of Police as a known or suspected thief or receiver of stolen property, or from any person failing or refusing to provide to the licensee all the identifying information required from the seller under Section 737.07(a).

   (c)    No scrap metal facility licensee shall purchase or receive any articles for sale for which the seller used the public sidewalk to carry, move or transport bulk scrap metal materials within the City by means of any shopping cart, wheeled tote of any sort, wagon, baby carriage or any other wheeled conveyance upon the public streets, alleys or sidewalks to carry, move or transport scrap metal materials to a scrap metal facility within the City. This section is intended to impose strict criminal liability. No culpable mental state is required to commit an offense of this section. (Ord. 2012-3-12. Passed 3-14-12; Ord. 2022-1-3.
