737.07 RECORDS OF TRANSACTIONS; DAILY REPORTS TO POLICE.
(a) All scrap metal facility licenses shall maintain a separate record book or electronic file in which the licensee shall keep an accurate, legible and complete record of all of the following specified information for each retail transaction:
(1) A complete and accurate description, including the weight if customarily purchased by weight, of any scrap metal article or material that has been purchased or received by the licensee, which description shall be as set forth in Ohio Revised Code Section 4737.04.
(2) The date, time, and place of the receipt of the scrap metal purchased or acquired and a unique transaction identifier.
(3) The seller's name and current address;
(4) The identification number from a current and a photocopy or electronic scan of a valid driver's license, military identification, or other photo identification card issued to the seller by the federal government or any state;
(5) The amount paid and the number of the check or electronic transfer used to purchase the scrap metal:
(6) The license plate number and state issuing the license plate of the motor vehicle, including any identifying marks on the vehicle, such as a business name, decals, or markings, if applicable, being used by the seller to transport the articles or material to the facility;
(7) A photograph of the seller;
(8) A photograph of the load of scrap being sold;
(9) A statement signed by the seller, under penalty of perjury, attesting that the scrap metal is not stolen and is free of any liens or encumbrances and the seller has the right to sell it;
(10) A copy of the receipt, which must include at least the following information: the name and address of the dealer, the date and time the scrap metal was received by the dealer, an accurate description of the scrap metal, and the amount paid for the scrap metal;
(11) The date and time that the licensee purchased or received the article or material and the name of the individual employee or operator of the facility who conducted the transaction;
(12) Seller's date of birth; and
(13) If the article or material that has been purchased or received by the licensee is a motor vehicle or a part thereof, the record shall include the vehicle identification number of that motor vehicle or part thereof as shown on the certificate of title.
(b) Every retail transaction shall be numbered consecutively.
(c) The licensee shall prepare a daily report listing all retail transactions occurring during the preceding day and containing all the information described in this section for each retail transaction. Before 12:00 noon each day, the licensee shall deliver a copy of the licensee's prior day's report to the Chief of Police or his or her designee. Delivery of the daily report shall be by means of a computerized tracking system approved by the Chief of Police or his or her designee. Unless delivered to the Chief of Police via the approved computerized tracking system, the photograph of the seller and the photograph of the load of scrap being sold as required by subsections (a)(7) and (a)(8) of this section shall be retained by the licensee in accordance with subsection (d) of this section.
(d) The records described in this section shall be retained by the licensee for ninety (90) days following the date of the retail transaction.
