737.10 PURCHASE OF CERTAIN ARTICLES RESTRICTED.
   (a)    No scrap metal facility licensee shall purchase or receive any restricted article in a retail transaction unless at the time of the transaction the seller has received reasonable, reliable, written documentation verifying that the seller is the owner of the article, or is an employee, agent, or other person authorized to sell the article on behalf of the owner.
   (b)    For purposes of this section, "restricted article" means all of the items described as a "special purchase article" in Ohio Revised Code Section 4737.04.
   (c)    No scrap metal facility licensee, including an agent, employee or representative of the licensee shall purchase, acquire or receive any catalytic converter in a retail transaction unless:
      (1)    At the time of the transaction, the scrap metal facility licensee, including an agent, employee, or representative of the licensee shall verify, with the applicable documentation described in paragraph (a) of this Section, that the person transferring or selling the catalytic converter, has acquired it legally and has the right to transfer or sell it; and
      (2)    In addition to the records required by Section 737.07, retain a record of the one of the following:
         A.    A certificate of title associated with the catalytic converter in the name of the seller; or
         B.    A receipt from a person or company that repairs, overhauls, dismantles, or does any mechanical work to motor vehicles that includes, at a minimum: (1) the name, address, and telephone number of the person or company that removed the catalytic converter; (2) the name of the person for whom the work was completed; (3) the year, make, and model of the vehicle from which the catalytic converter was removed; and (4) the vehicle identification number and/or the license plate number and state issuing the license plate of the vehicle from which the catalytic converter was removed; or
         C.    A completed form including the following information: (1) the name, address, and telephone number of the person or company that removed the catalytic converter; (2) the name of the person for whom the work was completed; (3) the year, make, and model of the vehicle from which the catalytic converter was removed; and (4) the vehicle identification number and/or the license plate number and state issuing the license plate of the vehicle from which the catalytic converter was removed.
      (3)    No more than one (1) catalytic converter is purchased or received per seller per day. (Ord. 2022-1-3. Passed 1-12-22.)
