977.04 BASEBALL DIAMOND FEES; SOCCER FIELD FEES.
(a) “Resident” means an individual domiciled in the City.

(b) The fees for use of all municipal softball and hardball baseball diamonds except for Foundation Field and for all municipal soccer fields shall be as follows:

(c) The fees for use of Foundation Field shall be as follows:

(d) The City Manager may, but is not required to, modify or waive the fees set forth in subsections 977.04(b) and (c) under the following conditions and as the City Manager determines to be necessary:
(1) If the organization or sponsor for the event is a non-profit organization exempt under Section 501(c)(3) of the Internal Revenue Code;
(2) If the payment of overtime is not required for any City employees for any purpose related to said municipal softball, hardball baseball diamonds, except for Foundation Field, and all municipal soccer fields; and
(3) If the City Manager deems a modification or waiver is appropriate taking into consideration the benefit to the public and/or the purpose of the event for which a baseball diamond or soccer field is to be used.
