The Texas Alcoholic Beverage Code has been held to preempt any municipal legislation regarding alcohol unless explicitly authorized by state law. See Dallas Merchants and Concessionaires Association v. City of Dallas, 852 S.W.2d 489 (Tex. 1993) (holding that comprehensive state scheme of regulation preempts municipal legislation). Therefore, this chapter only contains legislation explicitly authorized by state law.
