10-404: MARIJUANA AND CONTROLLED DANGEROUS DRUGS PROHIBITED 1 :
   A.   For the purpose of this Section, the following terms shall have the meanings respectively ascribed to them in this subsection:
    CONTROLLED DANGEROUS SUBSTANCE: Any drug or substance included in schedules I through V of the Uniform Controlled Dangerous Substances Act found in title 63 Oklahoma Statutes section 2-101 et seq.; including, but not limited to:
      1.   Cocaine and its derivatives;
      2.   Opiates and opium derivatives such as heroin, codeine, pethidine, and morphine;
      3.   Hallucinogenic substances including lysergic acid diethylamide, marijuana (Cannabis sativa L.), including seed of mature plants, mescaline, psilocybin, and various types of methoxyamphetamines;
      4.   Stimulants such as amphetamines and methamphetamines; or
      5.   Barbituarates and other depressants such as amobarbital, secobarbital, pentobarbital, phenobarbital, methoqualine, phencyclidine, and diszepam.
   DELIVER OR DELIVERY: The actual, constructive or attempted transfer from one person to another of a simulated drug or simulated controlled dangerous substance, whether or not there is an agency relationship.
   DRUG: 1. Substances recognized as drugs in the official United States Pharmacopoeia, official homeopathic pharmacopoeia of the United States or official national formulary or any supplement to any of them;
      2.   Substances intended for use in the diagnosis, cure, mitigation, treatment or prevention of disease in man or animals;
      3.   Substances intended to affect the structure or any function of the body of man or other animals; or
      4.   Substances intended for use as a component of any article specified in this definition. It does not include devices or their components, parts or accessories.
   MARIJUANA: All parts of the plant Cannabis sativa L., whether growing or not, the seeds thereof, the resin extracted from any part of such plant, and every compound, manufacture, sale, derivative, mixture or preparation of such plant, its seeds or resin, but shall not include the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil or cake, or the sterilized seed of such plant which is incapable of germination.
   PRACTITIONER:
      1.   A physician, dentist, podiatrist, veterinarian, scientific investigator or other person licensed, registered or otherwise permitted to distribute, dispense, conduct research with respect to, use for scientific purposes or administer a controlled dangerous substance in the course of professional practice or research in this State; or
      2.   A pharmacy, hospital, laboratory or other institution licensed, registered or otherwise permitted to distribute, dispense, conduct research with respect to, use for scientific purposes or administer a controlled dangerous substance in the course of professional practice or research in this State.
   SIMULATED DRUGS OR SIMULATED CONTROLLED DANGEROUS SUBSTANCES: Any product which identifies itself by using a common name or slang term associated with a controlled substance and which indicates on its label or accompanying promotional material or it is represented that the product simulates the effect of a controlled dangerous substance.
   B.   It is unlawful for any person knowingly or intentionally to possess marijuana unless such substance was obtained directly, or pursuant to a valid prescription or order from a practitioner, while acting in the course of his professional practice.
   C.   It is unlawful for any person to deliver any simulated drug or simulated controlled dangerous substance to another person. (Ord. 267, 5-4-1982; amd. Ord. 268, 5-4-1982)
