A. By City Manager. The City Manager shall have the authority to declare an emergency whereby the provisions of the Competitive Bidding Act of 1974 with reference to notice and bids shall not apply to supplies, materials, equipment or Contractual Services less than Seventy-Five Thousand Dollars ($75,000.00). A full report of the circumstances of the emergency purchase shall be reported to the Council, filed by the City Manager with the City Clerk, and shall be open to public inspection.
B. By Department Head. In case of actual emergency occurring during normal office hours the head of any using agency may, with written approval of the City Manager, purchase directly any supplies, material, equipment or contract for services whose immediate procurement is essential to prevent delays in the work of the using agency which may vitally affect the life, health or convenience of the citizens.
