7-102: DEFINITIONS:
As used in this chapter:
CITY:
The City of Grove, Oklahoma, and means the City government in all its forms, including not only all City departments but also any other person or entity acting for or on behalf of the City of Grove, provided, however, that any improvement district created pursuant to 11 O.S.2001, §§ 39-101, et seq., shall not be included in this definition thereby exempting such improvement districts from the provisions of this chapter.
CITY MANAGER:
The chief executive officer and the purchasing agent of the City or his or her designee.
CONSTRUCTION MANAGEMENT TRADE CONTRACT OR SUBCONTRACT:
Any construction contract exceeding $50,000.00 in an amount that is awarded as a trade contract in an agency construction management contract or awarded as a subcontract in an at-risk construction management contract.
CONTRACTUAL SERVICES:
Services performed for the City by persons not in the employment of the City, and may include the use of equipment or the furnishing of commodities in connection with the services under express or implied contract. Contractual Services includes services of a person, agency or group that are not a Professional Service (as herein defined). Contractual Services shall not include services or maintenance authorized and provided for an improvement district pursuant to 11 O.S. 2001, § 39-103.1.
COOPERATIVE PURCHASING PLAN:
an agreement entered into between two or more entities of government for acquisitions pursuant to a single or joint contract obtained through a competitive bidding process or issued in accordance with the authority granted to governmental entity.
COUNCIL:
Governing body of the City.
DEPARTMENT HEAD:
The person that is the head of a major function of the City and reports directly to the City Manager.
FINANCIAL INTEREST:
Ownership of more than five percent (5%) of the business or of the common stock therein.
ITEM:
Anything that is one (1) each, i.e., one (1) backhoe, one (1) car, one (1) radio, one (1) total project, one (1) service contract. An Item cannot be subdivided to avoid the requirements of this Chapter.
PROFESSIONAL SERVICE:
Services as defined in Section 803 of Title 18 of the Oklahoma Statutes.
PUBLIC CONSTRUCTION PROJECT OR CONTRACT:
Any contract awarded by the City for the purpose of making any Public Improvements (as hereinafter defined) and the cost exceeds the amount of $100,000.00 as set by the Oklahoma Public Competitive Bidding Act.
PUBLIC IMPROVEMENT:
Any beneficial or valuable change or addition, betterment, enhancement or amelioration of or upon any real property, or interest therein, belonging to the City, intended to enhance its value, beauty, or utility or to adapt it to new or further purposes. The term does not include the direct purchase of equipment, materials, or supplies provided that the equipment, materials or supplies are not purchased increments for an amount of less than the amount set by the Oklahoma Public Competitive Bidding Act and used for the purposes of completing a Construction Project, or any personal property as defined in paragraphs 1 and 4 of subsection B of Section 430.1 of Title 62 of the Oklahoma Statutes.
PURCHASING COOPERATIVE:
An association of public entities working together to provide leverage in achieving best value and/or the best terms in contracts awarded through a competitive bidding process. (Ord. 807, 10-19-2021)
