(A) Whenever deemed necessary, the Wastewater Utility Manager may require users to restrict their discharge during peak flow periods, designate that certain wastewater be discharged only into specific sewers, relocate or consolidate points of discharge, separate sewage wastestreams from industrial wastestreams, and such other conditions as may be necessary to protect the POTW and determine the user’s compliance with the requirements of this subchapter.
(B) The Wastewater Utility Manager may require any person discharging into the POTW to install and maintain, on his or her property and at his or her expense, a suitable storage and flow-control facility to ensure equalization of flow. A wastewater discharge permit may be issued solely for flow equalization.
(C) Users with the potential to discharge flammable substances may be required to install and maintain an approved combustible gas detection meter or provide appropriate treatment to remove any such substance.
(D) Users that operate vehicular wash facilities shall provide, operate, and maintain pretreatment facilities approved by the Wastewater Utility Manager to control solids and preclude the discharge of toxics to the POTW.
(E) Users which operate food preparation facilities shall provide, operate, and maintain pretreatment facilities approved by the Wastewater Utility Manager to control the discharge of greases, fats, oils, and food solids to the POTW. The design, installation, operation, and maintenance of these facilities shall, at a minimum, comply with the provisions set forth in §§ 51.135 through 51.146.
(F) The Wastewater Utility Manager may require users to purchase, install, and maintain, for the city’s monitoring purposes, such sampling, flow monitoring, laboratory, or other such equipment deemed necessary to determine compliance with categorical pretreatment standards, local limitations, NPDES pretreatment permit limitations, or any other discharge limitation imposed by this subchapter or at the express authorization of the Wastewater Utility Manager.
(G) The Wastewater Utility Manager may require users to reimburse the city for fees incurred for any analytical testing deemed necessary to determine compliance with categorical pretreatment standards, local limitations, NPDES pretreatment permit limitations, or any other discharge limitation imposed by this subchapter or at the express authorization of the Wastewater Utility Manager.
(H) Calibration of flow measurement devices, continuous monitoring devices, process control devices, treatment control devices, or any other device utilized for the monitoring or treatment of wastewater must be calibrated on a schedule approved by the Wastewater Utility Manager.
(I) When required by the Wastewater Utility Manager, the user of any property served by a building sewer carrying industrial wastes shall install a suitable control manhole in the building sewer to facilitate the observation, sampling, and measurement of the wastes. Such manhole, when required, shall be accessible and safely located, and shall be constructed and located in accordance with plans approved by the City Engineer. The manhole shall be installed so as to be safe and accessible at all times.
(J) All measurements, tests, and analyses of characteristics of waters and wastes shall be determined in accordance with 40 C.F.R. part 136 and shall be at an approved location and in accordance with § 51.119.
(K) No unauthorized person shall maliciously, willfully, or negligently break, damage, destroy, uncover, deface, or tamper with any structure appurtenance, or equipment which is part of the POTW or installed for the purpose of determining compliance with categorical pretreatment standards, local limitations, NPDES pretreatment permit limitations, or any other discharge limitation or requirement imposed by this subchapter.
(L) If any waters or wastes are discharged, or are proposed to be discharged, to the POTW which contain substances or possess characteristics outlined in § 51.114, or, in the judgment of the Wastewater Utility Manager or the City Engineer, may have a deleterious effect on the POTW or which otherwise create a hazard to life or constitute a public nuisance, the Wastewater Utility Manager shall:
(1) Require new industries or industries with significant increase in discharges to submit information on wastewater characteristics and obtain prior approval for discharges;
(2) Require other methods of disposal;
(3) Require pretreatment to an acceptable condition for discharge to the POTW;
(4) Require control over the quantities and rates of discharge;
(5) Require facilities to prevent accidental discharge of any unacceptable wastes; and/or
(6) Require payment to cover the added cost of handling and treating the discharge not covered by sewer charges under the provisions of Chapter 51 and all ordinances amendatory thereof and supplemental thereto, and any fines, penalties, or damages assessed against the city for discharge of such wastes to the city.
