ORDINANCE NO. 723
AN ORDINANCE OF THE CITY OF GOODING, IDAHO, A MUNICIPAL CORPORATION, PROVIDING FOR THE CLOSING OF A PORTION OF 9TH AVENUE EAST, TO THROUGH TRAFFIC, PROVIDING A PENALTY FOR TRAFFIC VIOLATIONS, FOR THE REPEAL OF CONFLICTING ORDINANCES, PROVIDING FOR SEVERABILITY, PROVIDING FOR PUBLICATION OF SUMMARY, AND PROVIDING AN EFFECTIVE DATE.
   WHEREAS, the North Valley Academy is a school within the City of Gooding; and
WHEREAS, students of North Valley Academy are loaded and unloaded from their respective school busses on 9th Ave. East between Main Street and Montana Street; and
WHEREAS, the canal that runs parallel to 9th Street makes 9th Street particularly narrow in the section between Main Street and Montana Street; and
WHEREAS, the City of Gooding has an interest in protecting students and other pedestrians who are engaged in loading and unloading from busses, as well as other pedestrian traffic from the school, from automobile traffic in the area; and
WHEREAS, the City further finds that the adoption of this ordinance is in the best interest and welfare of the residents of the City of Gooding.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GOODING, IDAHO:
SECTION 1:    
That 9th Avenue East, between Main Street and Montana Street, shall hereinafter be closed to through traffic. Any vehicle that travels from Main Street to Montana Street, or Montana Street to Main Street, shall be in violation of this ordinance.
That school busses engaged in the transportation of students to or from North Valley Academy are not subject to the provisions of paragraph (a) above.
SECTION 2:   That Gooding City Code Chapter 12 be amended by the addition of a new section, § 10-12-4 which will read as follows:
§ 10-12-4: Any person violating any section of Chapter 10, Gooding City Code, shall be guilty of an infraction and subject to a fine of Seventy-Five Dollars ($75.00).
SECTION 3:   Repealer Clause. All Ordinances and Resolutions or parts thereof in conflict herewith are hereby repealed and rescinded.
SECTION 4:   Severability Clause. If any section or portion of this ordinance is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance.
SECTION 5:   Effective Date. This Ordinance shall take effect and be in force from and after its passage, approval, and publication as required by law.
