6-12-3: CURFEW HOURS, EXCEPTIONS AND VIOLATIONS:
   A.   Night Time Curfew: It shall be unlawful for any minor person under the age of eighteen (18) years to loiter, idle, wander, stroll, play, drive, or otherwise be upon the public streets, highways, roads, sidewalks, alleys, parks, playgrounds, or other public grounds, or public places, or buildings, or other property generally open to public use or vacant lots within the City of Gooding, from 11:00 o'clock p.m. to 5:00 o'clock a.m.
   B.   Exceptions: A minor person shall not be subject to the curfew hours stated in division (A) above under the following circumstances:
      1.   When accompanied by a parent or legal guardian.
      2.   When engaged in lawful, gainful employment, or when going to or returning from such employment without any detours or stops, unless such detours or stops are approved in writing by a parent or legal guardian.
      3.   When engaged in lawful work, or when going to or returning from such volunteer work without any detours or stops, unless such detours or stops are approved in writing by a parent or legal guardian.
      4.   When engaged in the performance of a lawful errand at the written direction of a parent or legal guardian.
      5.   When, with written permission of a parent or legal guardian, attending an official activity sponsored by a local school district, religious organization, governmental entity, civic organization, youth organization, recreation district, or other like organization when such activity is supervised by adults; or when going to or returning from such activity without any detours or stops, unless such detours or stops are approved in writing by a parent or legal guardian.
      6.   When a justifiable emergency arises; or when immediate action is required to protect life or property.
      7.   When minor is lawfully married.
      8.   When the minor person is a member of the military service of the United States of America while performing such duty.
      9.   When the minor person is exercising any of the rights guaranteed such minor person by the Constitution of the United States of America and/or the Constitution of the State of Idaho. (Ord. 714, 3-2-2020)
