7-1-5: PENALTIES:
   A.   Any person who shall violate any of the provisions of this Code or Standards hereby adopted, or fail to comply therewith, or who shall violate or fail to comply with any order made hereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the Fire Chief or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance, be guilty of a misdemeanor, punishable by a fine of not less than twenty five ($25.00) nor more than three hundred dollars ($300.00) or by imprisonment for not less than five (5) days nor more than one hundred eighty (180) days or by both such fine and imprisonment. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten (10) days that prohibited conditions are maintained shall constitute a separate offense.
   B.   The application of the above penalty(s) shall not be held to prevent the enforced removal of prohibited conditions.
   C.   The City may enforce any of the above provisions in this Chapter either civilly, criminally or both. In the event the property owner maintains a property in violation of any of the provisions of this Chapter, such violation will also be considered a nuisance. The City may remove or abate such nuisance from the property upon which the same exists after giving the owner thereof notice to remove the same within fifteen (15) days, and upon the failure of said owner to remove or cause the nuisance to be removed within said time, the expense thereof to the City may be certified to the proper officer of Gooding County, Idaho for other taxes as provided by law, specifically section 50-334 Idaho Code, as amended.
