505.11 HUNTING AND TRAPPING.
   (a)   No person shall hunt, trap, kill or attempt to kill any animal or fowl by the use of firearms, bow and arrow, air rifle or any other means within the corporate limits of the Municipality, except as specified below and except for the powers conferred upon the Village’s Animal Warden pursuant to Village of Glenwillow Codified Ordinance Section 121.01. This section shall not prohibit the use of body traps or other legal killing traps by a landowner or tenant in the Village of Glenwillow in order to control nuisance rodents on such property.
   (b)   It shall be lawful for all persons owning land located within the Village of Glenwillow, or the tenants of such landowners, with the landowner’s written permission, to live- trap nuisance non-migratory animals on such property subject to the following limitations and requirements:
      (1)   Such trapping shall be in accordance with state law.
      (2)   Deer, black bear and wild turkey may only be trapped with written permission from Division of Wildlife of the State of Ohio.
      (3)   Every person who live-traps an animal must release the animal within twenty-four hours from the time of capture. Trapped animals must be released outside the Village’s corporate limits and shall not be released, on public or private property, without the owner’s permission.
      (4)   If the animal trapped is a raccoon, skunk, opossum, coyote or fox, such animal shall be euthanized, or released on site. If the landowner or tenant does not timely release the animal on site, such person shall notify the Village of Glenwillow Animal Warden to euthanize the animal, who shall do so pursuant to Village of Glenwillow Codified Ordinance Section 121.01.
      (5)   All traps used to capture wild animals must have affixed to them, a waterproof tag, or other permanent means of indicating the user’s name and address.
      (6)   It shall be unlawful for any person to sell, use or give to another person any wild animal trapped for removal.

   (c)   It shall be lawful for persons owning land within the Village of Glenwillow, their resident tenants, other invited Village residents, and invited non-resident guests, upon written permission obtained from the landowner, to hunt deer and wild turkey using either bow and arrow or crossbow within the corporate limits of the Village of Glenwillow provided that such landowners and permitted hunters strictly adhere to the following provisions:
      (1)   The owner of the land upon which hunting takes place must own a minimum of three contiguous acres. Adjoining property owners may enter into a collaborative agreement in writing in order to meet the minimum acreage requirement.
      (2)   Hunters can hunt from an elevated stand or position.
      (3)   Any landowner or tenant on such property or invited non-landowner guest, whether a resident of the Village or not, wishing to hunt within the corporate limits of the Village shall register with the Village Police Chief and obtain a Village bow hunting registration card valid for one full deer season before beginning hunting. In order to obtain such Village bow hunting registration card, the potential hunter must show the Chief of Police proof that he or she has successfully completed the hunter safety training course offered by the Ohio Division of Wildlife and display to the Chief the written permission of the landowner. The Chief of Police shall retain a copy of the written permission of the landowner. The Village shall not charge a fee for the annual registration.
      (4)   Any landowner of at least 3 acres may invite a tenant or a non-tenant guest, whether a resident of the Village or not, to hunt on such landowner's property. Such landowner's permission shall be in writing and shall only be for one hunting season or shorter time if the landowner so indicates in writing.
      (5)   Any owner of 3 acres of land in the Village or the resident tenant of same or guest that is a resident of the Village is entitled to a Village deer bow hunting registration card so long as the conditions in this section are followed, but the Chief of Police shall only have 30 Village deer bow hunting registrations per deer season to distribute to non-landowner guests that do not reside in the Village.
      (6)   All hunters permitted under this section shall, while hunting in the Village, carry on their person, the appropriate current and valid State of Ohio hunting licenses, the current and valid written permission to hunt signed by the landowner, the current and valid Village registration signed by the Chief, and a picture identification such as drivers license.

   (d)   Whoever violates this section is guilty of a minor misdemeanor.
