1329.01 PERMIT AND INSPECTION DEPOSIT REQUIRED.
   Before any public street or road or area within the right-of-way of such public street or road in the Village is opened, excavated, or tunneled under, the person desiring to do so shall obtain a permit for such opening, excavation, or tunneling from the Village Chief Building Official. The applicant for such a permit shall apply on forms provided by the Village Chief Building Official and pay the permit fee as required by the Building Department. Such applicant shall be obligated to pay for any police protection and/or traffic control necessitated by the construction activity authorized by the permit. The Chief of Police or his designee shall determine the method of payment for any such police protection and/or traffic control. Such applicant shall also deposit with the Village an amount of cash as determined by the Village Engineer to cover the estimated cost that will be incurred by the Village in supervising and/or inspecting due to such opening, excavation, or tunneling. The Village Chief Building Official shall not issue a permit without first obtaining the required deposit as described above unless there is a waiver of such deposit in accordance with Section 1329.02 below. If the actual supervisory or inspection costs occasioned by the construction activity authorized by the permit exceeds the amount of the deposit after construction is complete, then the applicant shall be responsible for such additional costs. If the deposit exceeds the actual costs, then the balance shall be returned to the applicant.
