(a) It may be necessary and/or required from time to time for non-exempt employees to work overtime; or in excess of forty (40) hours in a work week. All overtime must be approved by the Mayor through the department supervisor and must be by prior written authorization. If the Mayor cannot be reached and if the need for overtime is of utmost importance for the public peace, health, safety, and should take place immediately, the supervisor has the right to make the decision for overtime.
(b) When a full-time police officer is in the course of a continuing criminal investigation, during which the officer's normal tour of duty had terminated for that particular workday, and if, in the opinion of such officer's immediate superior officer, it is necessary to conduct such an investigation without interruption, such officer shall receive overtime compensation for each hour and/or fraction thereof spent in furtherance of such an investigation after his normal tour of duty. When an off-duty police officer is required to work for the Village during his scheduled off-duty hours due to an emergency or other compelling situation, such officer shall receive overtime compensation for each hour and/or fraction thereof that is worked during his scheduled off-duty hours.
(c) Overtime is paid at the rate of one and one-half (1 1/2) times the employee's regular rate of pay. Vacation, holiday and personal leave count as hours worked for purposes of calculating overtime.
(d) Compensatory time in lieu of overtime compensation is not allowed.
(e) Non-exempt employees, other than police officers, who are paid on an hourly basis, shall receive time and one-half (1-1/2) for all hours worked in excess of forty (40) hours per week and for all services performed for the Village on a holiday as defined in Section 139.12
(a).
(f) Part-time police officers or reserve police officers shall be entitled to one and one-half (1-1/2) times their regular rate of pay for services performed on a holiday as defined in Section 139.12
(a).
(g) An employee who unreasonably refuses to work a mandatory overtime assignment may be considered insubordinate and may be disciplined accordingly, including, but not limited to, termination.
(h) Sick time does not count for purposes of calculating overtime.
(i) Employees called out for emergency situations (snow plow, post storm, etc.) shall be paid a minimum of three (3) hours, counted at the time they arrive at the Village.
(j) Non-exempt employees called to work on days listed as a paid holiday in Section 139.12(a) shall receive overtime for hours worked.
