If the permit issued under this article is terminated by the village, the deposit made with the village manager provided for in the preceding section shall be used to restore the parkway to the condition existing prior to its construction; provided, that the person placing the deposit with the village fails to restore the parkway in accordance with the provisions of this article within nine days.
