The following additional restrictions apply to solicitation on any street or any intersection of two or more streets within the village:
(a) Solicitation may be conducted only the purpose of conducting charitable solicitation.
(b) No person may engage in solicitation in a manner that poses an undue risk to the safety of that person or any other person, whether a pedestrian or driver. No person may solicit in a manner that interferes with the ability of traffic to proceed safely and as directed by traffic signs or signals. No person engaged in solicitation may stand in any lane designated for vehicular traffic when that lane has a green light or similar traffic signal directing vehicles to proceed.
(c) No person may use any sound-producing or sound-amplifying device while engaging in solicitation.
(d) No person may use a sign, flag, banner, balloon, or any other attention-getting device of any type while engaged in solicitation.
(e) Notwithstanding any other provision of this article, no person may engage in solicitation before 7:00 a.m. or after 7:30 p.m.
(f) Each solicitor must be covered by, and provide to the village a certificate of insurance and additional insured endorsement, on a form at least as broad as Insurance Service Office (ISO) CG 20 10, as evidence of general liability insurance against bodily injury and property damage arising out of or in connection with the solicitation with a coverage limit of at least $1,000,000 per occurrence and naming the village as an additional insured.
(g) No more than four individuals may solicit at one time within an intersection, and no more than two individuals may solicit the same lane of traffic.
(h) A permitted solicitor who intends to solicit in a street must present himself or herself at the village department of public safety and sign the registration book provided for that purpose. This sign-in requirement applies to each day of solicitation and must be complete before solicitation has begun for that day. If an entity is registered to solicit in the street, only one representative of that entity is required to present himself or herself at the department of public safety to sign in. That representative must identify the intersections at which individuals will solicit on behalf of the entity on that day.
(i) No person who is less than 18 years old may solicit in the street.
(j) Each solicitor must dress in a manner that is visible to motorists and reasonably identifies or distinguishes the person as a solicitor. Examples of appropriate clothing are: light- or bright-colored matching shirts, hats, or jackets; reflective vests or jackets; or light- or bright-colored apparel clearly displaying the name or logo of the soliciting entity.
(k) The village manager, at his or her sole discretion, may prohibit or restrict solicitation at any intersection on any date and time if he or she determines that the solicitation would create a hazardous condition; create undue risk to the safety and welfare of motorists, pedestrians, or solicitors; or interfere with the safe and orderly movement of traffic. The village manager may determine that the prohibition or restriction of solicitation in the street is necessary due to conditions such as, but not limited to, the condition of roadway lighting or visibility, construction work or detours, special events, traffic congestion, or adverse weather.
