§ 23-74 NEGLIGENT DRIVING.
   It shall be unlawful for any person to operate any vehicle upon a public way negligently so as to endanger or be likely to endanger any person or property. Without limiting the foregoing, for purposes of this section, it shall be presumed that a person has operated a vehicle negligently and is endangering or is likely to endanger persons or property if such person:
   (a)   Uses a wireless telephone as defined in 625 ILCS 5/12-610.1(a) while operating a vehicle; and
   (b)   Operates the vehicle in a manner that violates any law or regulation governing the movement of vehicles on any public way.
