§ 21-46 DEFINITIONS.
   The following words, terms and phrases, when used in this article, shall have the meaning described herein in this section, except where the context could indicate a different meaning.

   COST INCURRED BY VILLAGE. All costs and expenses of the village in connection with the cleanup or abatement of the discharge of hazardous materials or the extinguishing of a fire involving hazardous materials and shall include, but shall not necessarily be limited to, the following: actual labor costs of village personnel involved in cleanup or abatement of the discharge (including workers compensation benefits, fringe benefit and administrative overhead); cost of equipment operation, damage or loss as solely determined by the village; cost of materials obtained by the village; and cost of any contract labor and materials.
   DISCHARGE. To leak, seep, spill or to otherwise release.
   HAZARDOUS MATERIAL. Any substance or material which, due to its quantity, form, concentration, location or other characteristics, is determined by the public safety director or his or her authorized representatives to pose an unreasonable and imminent risk to life, health or safety of persons or property or to the ecological balance of the environment including, but not limited to, explosives, radioactive materials, petroleum or petroleum products or gases, poisons, etiologic (biological) agents, flammables, corrosives or any substance determined to be hazardous or toxic under any federal or state law, statute or regulation.
   THIRD PARTY. Any person or company or business entity, other than the village and its officers and employees.
