§ 21-14.2 EMISSION OF DENSE SMOKE PROHIBITED AND DECLARED NUISANCE.
   (a)   It is unlawful for any person to cause or permit the emission of any dense smoke from any source whatever, except when a firebox, furnace, boiler or other fuel consuming device is being cleaned out and a new fire is being built therein, in which event dense smoke may be emitted there from for a period of not to exceed six minutes in any single period of 60 minutes. The emission of dense smoke is declared to be a public nuisance unless falling within the foregoing exception.
   (b)   The owner, proprietor, lessee or occupant of any building or the person in charge of the furnace therein who causes, permits or allows dense smoke to issue or be emitted from the smoke stack of any stationary furnace or the chimney or smoke stack of any building in the village, contrary to the provisions of this code, is guilty of maintaining a nuisance.
