§ 9-125 EXCAVATIONS - WHEN ALLOWED; NUISANCES.
   In addition to the other requirements of this chapter, excavations may be undertaken and maintained only in connection with active construction, and in the event that active construction in connection with any excavation ceases or is otherwise abandoned for a period in excess of 30 days, the person responsible for making or causing such excavations shall cause such excavations to be filled with clean fill and shall compact such fill in such a manner as to provide sufficient support and avoid all danger to life or limb. Any excavation maintained in violation of this article is hereby declared to be a public nuisance and shall, in addition to being subject to the enforcement and penalty provisions of this chapter, be subject to the abatement and penalty provisions made applicable to nuisances pursuant to chapter 24 of this code.
