§ 9-78 FENCE BOARD OF APPEALS.
   (a)   There is hereby created a fence board of appeals consisting of those persons who are from time to time the members of the zoning board of appeals. The chairperson of the zoning board of appeals shall serve as the chairperson of the fence board of appeals.

   (b)   Meetings of the fence board of appeals shall be held at the call of the chairperson. The board shall keep minutes of its proceedings and records of its examinations and other official actions. A majority of the members of the board shall constitute a quorum for the conduct of business and the board may act by a majority of those present at a meeting at which a quorum is present. The chairperson shall have the power to vote. The board may adopt its own rules of procedure not inconsistent with this article.
   (c)   The fence board of appeals shall, after public notice and hearing, have the authority to finally grant or deny all requests for variations in the height or density of any fence or wall filed pursuant to § 9-79 of this article.
   (d)   The fence board of appeals shall consider appeals of denials of fence permits pursuant to § 9-75(c) of this article. In considering any such appeal, the fence board may affirm, reverse or modify the decision of the village manager upon finding that the manifest weight of the evidence requires a different result based on the objectives of providing for protection of persons and property while minimizing visual obstructions resulting from the fence.
