§ 9-71 ENCLOSURES.
   (a)   Every owner, purchaser under contract, lessee, tenant or licensee of a lot or premises upon which a private swimming pool is situated shall maintain at all times on such lot or premises a fence or other structure designed to completely surround such pool or yard area. Such fence or other structure shall be not less than four feet in height, with no gaps, openings or apertures (other than doors or gates), that will not allow the passage of a sphere with a diameter equal to or greater than four inches.

   (b)   All gates or doors opening through a fence or enclosure maintained in accordance with this section shall be equipped with a self-closing or self-latching device placed at the top of such gates or doors and made inaccessible to small children. Such devices shall be so designed as to be capable of keeping such doors or gates securely closed at all times when not in actual use; provided, however, that the door of any dwelling forming a part of the enclosure need not be so equipped.
