§ 9-67 DEFINITION.
   For the purpose of this article, a PRIVATE SWIMMING POOL shall mean a human-made rigid or semi-rigid receptacle for water having a depth at any point greater than 18 inches, used or intended to be used for swimming, wading or bathing and constructed, installed or maintained in or above the ground, and which is used exclusively by the owner or occupant of the lot or premises in the village on which it is located, his or her family and his or her guests. This definition shall not include installations commonly known as "hot tubs" having a surface area of not greater than 42 square feet and which are not used for swimming; provided, however, that any such hot tub shall either:
   (a)   Be completely surrounded by a fence or other structure not less than four feet in height having no gaps or apertures (other than doors or gates) with any dimension greater than four inches, provided that such fence or other structure shall be in addition to any fence that may be in place around the perimeter or the premises on which such hot tub is located; or
   (b)   Be completely and securely covered with a covering that will:
      (1)   Support a weight of at least 300 pounds per square foot; and
      (2)   Be securely fastened at all times that it is not attended and supervised by a responsible person.
