§ 2-154 ADVISORY OPINIONS; ETHICS BOARD.
   (a)   Advisory opinions. When an officer or employee of the village is uncertain as to the existence of a conflict of interest under this division 2, the officer or employee may apply to the village manager for an advisory opinion. The village manager, in consultation with the village attorney, may advise the officer or employee as to the applicability of the provisions of this division.
   (b)   Village board determination. When an officer is uncertain as to the existence of a conflict of interest in a situation in which resignation would be required under this division 2, the officer may apply to the village board for a determination as to whether resignation is required or whether an exemption is warranted. An exemption may be warranted if the officer's interest is de minimis or if the transaction or issue at question is not extraordinary or likely to give rise to a dispute. The officer shall have the opportunity to present his or her interpretation of the facts at issue and of the applicability of the provisions of this division before the determination is made. Such determination shall be made at a regular meeting of the board. Prior to such board meeting, the village president may require the officer to provide information relevant to the issue presented, to notify owners or occupants of properties within 250 feet of a property that is the subject of a transaction, or to undertake such other reasonable steps to ensure that the village board may make an informed determination.
