922.005 PURPOSE.
   The purpose of this chapter is to provide an effective organization, method of finance, drainage code and appropriate rules and regulations for the management of stormwater through a stormwater management utility. Additionally, the provisions of the Federal Water Pollution Control Act and the Ohio Water Pollution Control Act that require the Village to maintain a Stormwater Management Program (SWMP), and to implement best management practices.

922.01 DEFINITIONS.
   For the purpose of this chapter, the words and phrases shall be defined as follows, unless the context clearly indicates or requires a different meaning.
   (a)   “Stormwater Management Utility” means the Division of the Department of Public Services known as the Stormwater Management Utility, within the Village, which shall be responsible for developing and implementing stormwater management plans and the operation, maintenance and improvement of the storm water system. This Division shall be funded by a service charge based upon individual contributions of runoff to the system, benefits enjoyed and services received. The Division of Stormwater Management Utility shall be administered by the Director.
   (b)   “Director” means the Director of the Stormwater Management Utility who shall be the head of the Department of Public Service.
   (c)   “Stormwater system” means all manmade facilities, structures and natural watercourses used for collecting and conducting stormwater to, through and from drainage areas to the points of final outlet including, but not limited to, any and all of the following: conduits and appurtenant features, canals, creeks, channels, catch basins, ditches, streams, gulches, gullies, flumes, culverts, siphons, streets curbs, gutters, dams, floodwalls, levees and pumping stations.
   (d)   “Impervious area” includes the total vertically projected surface area of roofs, patios, walkways, driveways, parking areas and other such area subject to rainfall which presents itself substantially resistant to water absorption or penetration or fails to substantially and consistently detain rainfall.

922.02 CLASSIFICATION OF PROPERTY.
   There shall be three classification of property:
   (a)   Residential Structures. A residential structure is a structure or building, or portion thereof, designed exclusively for use of residence purposes.
   (b)   Business Structure. A business structure is a structure or building wherein an occupation enterprise, undertaking or employer engages in the purchase, sale, barter or exchange or goods, wares, merchandise or services, or where there is the maintenance or operation of an office or offices for the exhibition, sale or offering of merchandise or services.
   (c)   Industrial Structure. An industrial structure is a structure or building wherein an enterprise or undertaking engages in the manufacturing, assembling, or production of goods, wares, merchandise or products.
