(a) Submission. The subdivider shall prepare and submit an application for approval of a preliminary plat. Said application shall be filed with the City Manager's office at least fifteen working days prior to the Planning Commission meeting at which it is to be considered. All applications for preliminary plat approval shall include:
(1) A completed application form.
(2) Ten copies of the preliminary plat and supplementary material, as required in Section 1244.05.
(3) A plan review deposit, as set forth in Section 1242.05.
(4) A letter signed by the subdivider describing any waivers requested and the justification therefor, as set forth in Section 1242.04.
(b) Transmission. The City Manager may transmit copies of the plat to appropriate officials and agencies for their review and comments. Comments and recommendations from those officials and agencies shall be made available to the Commission.
(c) Commission Action. The Planning Commission shall review said plat and shall act thereon within forty-five days of the filing date, provided, however, that said time may be extended by mutual consent of the Commission and the applicant. The Commission may approve the plat as submitted or modified, conditionally approve the plat and stipulate the condition of such approval, or disapprove the plat.
(d) Notification. The subdivider shall be advised of the action of the Commission on the preliminary plat.
(e) Effect of Approval. Approval of a preliminary plat by the Planning Commission is not an acceptance of the subdivision for record. It is an approval of a general plan as a guide for the preparation of improvement plans and the final subdivision plat. Approval of a preliminary plat shall be effective for a period of one year following the date of approval by the Planning Commission, unless an extension of time is granted. Upon expiration of a preliminary plat approval, no approval of a final plat shall be given until the preliminary plat has been resubmitted and approved.
