(a) Any applicant wishing to demolish a building or structure in an area other than a historic district and/or a historic landmark designated structure shall first obtain a demolition permit from the Building Official.
(c) The Building Official may exclude minor buildings or structures from the permit requirement at his discretion. Such minor buildings or structures shall include garden sheds or uninhabitable outbuildings or structures.
(d) Upon receipt of the completed application for the demolition of any building or structure located outside of an historic district and not designated as an historic landmark, the Building Official shall first submit the application to the Architectural Board of Review. The Architectural Board of Review shall determine whether the building or structure has historic or architectural significance and determine whether the applicant for such permit will voluntarily consent to the retention of such building or structure as appropriate. For the purposes of this section, the term "alteration" and "remodeling" do include the term "demolition." For the purposes of this section, the term "demolition" shall mean the act of completely tearing down or removing a building or structure.
(1) If the Architectural Board of Review determines that the building or structure has historic or architectural significance, it shall refer the application to the Historic District Subcommittee which will review the application in accordance with the standards and criteria set forth in Section 1313.09.
(2) If the Architectural Board of Review determines that the building or structure does not have historic or architectural significance and further determines that the applicant for such permit will not voluntarily consent to the retention of such building or structure as appropriate, the Architectural Board of Review shall refer the application to the Planning and Zoning Commission which shall, at its first regular or special meeting after receipt of the application, review the application in accordance with the standards set forth in Section 1313.082.
