1313.082 PLANNING AND ZONING COMMISSION REVIEW OF APPLICATIONS FOR DEMOLITION OF BUILDINGS OR STRUCTURES.
     (a)   Upon receipt of the application having first been reviewed and referred by the Architectural and Board of Review, the Planning and Zoning Commission shall only authorize the Building Official to issue a demolition permit if, after review, it determines that the application meets the following criteria:
       (1)   The applicant has used the best available technology to mitigate any environmental problems identified in the application.
      (2)   The applicant has filed a bond guaranteeing the performance of the demolition activities.
      (3)   The applicant has contracted with a licensed contractor to perform the demolition activities.
      (4)   The applicant has provided a plan to utilize best available technology to mitigate the impacts of any off-site stormwater impacts.
      (5)   The applicant has provided a plan to eliminate nuisance conditions on the property after the demolition, including the filling of any basement foundation and the deactivation of any septic tank or water well, if abandoned, in accordance with Cuyahoga County Board of Health Rules and Regulations.
      (6)   The applicant has provided evidence that the demolition will not create adverse impacts on adjacent properties or adversely impact neighborhood property values and will not create ongoing nuisance conditions.
      (7)   The applicant has provided a plan to mitigate any other negative impacts identified by either the Building Official or the Village Engineer in their review of the application.
