§ 1.05.155  VILLAGE OF GARDNER P-TICKET ENFORCEMENT PROGRAM.
   (A)   The Village of Gardner hereby creates an enforcement vehicle which shall be known as the “P-Ticket” for the enforcement of certain ordinances. Persons who are issued a “P-Ticket” by appropriate village agents and employees shall be given the option of tendering a written plea of guilty along with payment of the fine set herein, and as hereafter amended, directly to the Village Clerk within 14 days of the issuance of “P-Ticket”. Persons who do not pay the fine and enter a plea of guilty within the given 14 days with the Village Clerk of the Village of Gardner shall be subject to summons to hearing in the Circuit Court and shall be subject to the full range of fines and penalties as provided by each separate village ordinance.
   (B)   “P-Tickets” shall not be issued to any one person who has been convicted or plead guilty to any one of the offenses enumerated on the “P-Ticket” three or more times in the past or any single time within a 12-month period.
   (C)   A “P-Ticket” shall be issued at the discretion of the village for violations of the following titles, chapters, subchapters, amendments and ordinances thereto:
      (1)   Title XI: Business Licenses and Regulations;
      (2)   Chapter 9.05: Animals;
      (3)   Chapter 9.20: Health and Safety;
      (4)   Chapter 13.10: Offenses Against Public Morals;
      (5)   Title V: Public Works;
      (6)   Chapter 15.15: Zoning;
      (8)   Chapter 9.20: Ordinance Prohibiting Certain Noises;
      (9)   Section 9.20.240: Ordinance Prohibiting Scavenging of Recyclable Materials From Curbside Recycling Bins;
      (10)   Chapter 7.25: Prohibiting Use of Skateboards and the Like; and
      (11)   Chapter 13.10: Ordinance to Suppress Graffiti.
   (D)   The fines to be collected upon the plea of guilty of a person charged with an ordinance violation by the “P-Ticket” method shall be $25.
   (E)   This section shall amend any existing ordinance inconsistent herewith. This section shall take full force and effect upon its due passage, notice and publication, as may be required by law.
