ORDINANCE NO. 001-2010

AN ORDINANCE ENACTING A CODE OF ORDINANCES FOR THE VILLAGE OF GARDNER REVISING, AMENDING, RESTATING, CODIFYING AND COMPILING EXISTING GENERAL ORDINANCES OF THE VILLAGE OF GARDNER, AND ADOPTING CERTAIN ZONING TEXT AMENDMENTS

WHEREAS, the present general and permanent ordinances of the Village of Gardner are inadequately arranged and classified and are insufficient in form and substance for the complete preservation of the public peace, health, safety and general welfare of the municipality and for the proper conduct of its affairs; and

WHEREAS, the Acts of the Legislature of the State of Illinois empower and authorize the Village of Gardner as set forth therein to revise, amend, restate, codify and compile any existing ordinances and all new ordinances not heretofore adopted or published and to incorporate such ordinances into one ordinance in book form; and

WHEREAS, the Village of Gardner has authorized a general compilation, revision and codification of the ordinances of the Village of Gardner of a general and permanent nature and publication of such ordinance in book form; and

WHEREAS, a Public Hearing was properly noticed and held before the Village of Gardner Planning & Zoning Board on Tuesday, April 6, 2010, at 7:00 p.m., with due notice having been published; and

WHEREAS, following the above Public Hearing, the Gardner Planning & Zoning Board unanimously recommended the adoption of the zoning text amendments associated with the codification of the ordinances of the Village of Gardner. A true and correct copy of the Findings and Recommendation of the Gardner Planning & Zoning Board is attached hereto as Exhibit A and incorporated herein; and

WHEREAS, after due consideration, the Gardner Village Council finds that it would be in the best interests of the residents of the Village of Gardner to follow the recommendations of the Gardner Planning & Zoning Board, and to approve the zoning text amendments.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND VILLAGE COUNCIL OF THE VILLAGE OF GARDNER, GRUNDY COUNTY, ILLINOIS, AS FOLLOWS:

Section 1. The above recitals are hereby found to be true and correct, and are hereby restated and incorporated into the body of this ordinance as though fully set forth herein.

Section 2. The general ordinances of the Village of Gardner as revised, amended, restated, codified and compiled in book form are hereby adopted as and shall constitute the “Code of Ordinances of the Village of Gardner, Grundy County, Illinois.” Said general ordinances are hereby incorporated into the body of this ordinance as though fully set forth herein.

Section 3. The zoning text amendments considered by the Planning & Zoning Board and recommended for approval are hereby approved and ratified in all respects.

Section 4. Such Code of Ordinances as adopted in Section 1 shall consist of the following Titles:

Section 5. All prior ordinances pertaining to the subjects treated in such Code of Ordinances shall be deemed repealed from and after the effective date of this ordinance except as they are included and re-ordained in whole or in part in such Code; provided, such repeal shall not affect any offense committed or penalty incurred or any right established prior to the effective date of this ordinance, nor shall such repeal affect the provisions of ordinances levying taxes, appropriating money, annexing or detaching territory, establishing franchises, or granting special rights to certain persons, authorizing public improvements, authorizing the issuance of bonds or borrowing of money, authorizing the purchase or sale of real or personal property, granting or accepting easements, plat or dedication of land to public use, vacating or setting the boundaries of streets or other public places; nor shall such repeal affect any other ordinance of a temporary or special nature or pertaining to subjects not contained in or covered by the Code.

Section 6. Such Code shall be deemed published as of the day of its adoption by the Gardner Village Council, and the Gardner Village Clerk is hereby authorized and directed to file a copy of such Code of Ordinances in the Office of the Clerk.

Section 7. Such Code shall be effective from and following its approval and publication in pamphlet form as required by law.

Section 8. The Village Clerk shall publish a true, correct and complete copy of the Code of Ordinances immediately from and following its approval for a period of not less than ten (10) days and shall complete a Certificate of Posting Consistent therewith.
