1345.05 PROCEDURES FOR THE IDENTIFICATION AND DESIGNATION OF A LISTED PROPERTY OR HISTORIC PRESERVATION DISTRICT.
      (a)   Any building in the Historic District area fifty (50) years old or which becomes fifty (50) years old and has significant architectural features shall be considered eligible for the Historic Preservation Board Register of Listed Properties. Any building in the Historic District area that has historic significance (as defined in 1345.02) shall be considered eligible for the Historic Preservation Board Register of Listed Properties.
   (b)   The Historic Preservation Board may recommend property within the City to the City Commission for designation as listed property and, possibly, part of a Historic Preservation District. Any property owner, organization or interested individual may apply to the Board for such designation.
      (1)   Procedures for Designation of a Listed Property. The Board shall notify the owner of any proposal to list his property, and secure the owner's written consent to the proposed designation before it is presented to the Commission.
      (2)   Procedures for Designation of a Historic Preservation District. The Board shall notify all property owners within a proposed Historic Preservation District that they are being considered for such designation. This notification shall be by certified mail to all known property owners and shall be followed up by newspaper notification as necessary. Written letters of disapproval must be received by the Board within 30 days of receipt of notification. If 50% or more of the affected property owners respond with disapproval district designation shall be considered null and void. Only one (1) letter shall be accepted from each property owner(s). In the event of multiple ownership within the proposed district, additional letters will not be accepted.
   (c)   The City Commission shall give due consideration to the recommendations of the Board and shall hold a public hearing on proposed designations with approval or denial to follow. After the decision by the City Commission, the Board shall notify any owner or person having legal or equitable interest in such property of the decision by the City Commission. If a historic preservation district is formed or added to, the district shall be added to the map attached hereto.
