(a) The food establishment permit required by the Recommended Uniform Food Establishment Regulations promulgated by the Ohio Department of Health shall be obtained from the City Health Commissioner on or before January fifteenth of each year following the enactment of this section and shall expire on the fifteenth day of January of each and every year thereafter.
(b) The City Health Commissioner shall charge the following fees for the issuance of a food establishment permit with such fees to be based upon the number of square feet of floor space required for the preparation, processing storage and display of food articles as follows:

(c) The following food establishments shall not be required to pay the permit fee set forth in this section; however, they are exempt only from payment of the fee but shall continue to be governed by all other food establishment regulations established by this and other chapters of this Code:
(1) Nonprofit organizations, churches, schools and other charitable organizations selling products for periods of less than seven consecutive days or for not more than fifty-two separate days in any one calendar year.
(2) Produce stands selling only fresh produce grown on the premises upon which the stand is located.
(3) Food service establishments where the authority of State law preempts coverage by the City, but only where the State law regulations cover the entire operation and management of the establishment.
