GENERAL PROVISIONS
§ 91.01 FIRE PREVENTION CODE ADOPTED.
   (A)   Adoption of Fire Prevention Code.
      (1)   There is hereby adopted, for the purpose of prescribing regulations governing conditions, hazardous to life and property from fire or explosion, the BOCA National Fire Prevention Code, most recent edition, as amended, as published by the Building Officials and Code Administrators International, Inc., save and except such portions as are hereinafter deleted, modified, or amended herein.
      (2)   A complete copy of this code, and supplements thereto, are available for public use and inspection ln the office of the Village Clerk.
      (3)   From and after the date on which this code shall take effect, the provisions of the BOCA Fire Prevention Code and supplements thereto shall be controlling within the limits of the village.
   (B)   Enforcement. The code hereby adopted shall be enforced by the Chief of the Dallas Township Fire Department and those persons designated by him or her and serving under him or her.
   (C)   Definitions. Wherever the words “name of jurisdiction” are used in the code herein adopted, those words shall mean the Village of Fowler and its prescribed jurisdictional boundaries. Wherever the words “name of state” are used, they shall mean the State of Michigan.
   (D)   Amendments to the adopted code. The code hereby adopted is amended to the extent that when any statute of the state or any ordinance of the village shall impose greater or more stringent requirements, the more stringent or more restrictive requirement shall apply; that no ordinance of the village setting forth less stringent requirements shall be operative; and the more restrictive requirements of either document being deemed to apply.

§ 91.02 RESTRICTIONS ON OPEN BURNING.
   (A)   It is a nuisance and is unlawful for any person to set fire in the streets or other open spaces within the village to any material, whether natural or man-made except as authorized in this section.
   (B)   The operation and use of any "burner barrel," trash barrel to contain fire or other outdoor fire disposal system within the village is prohibited.
   (C)   It is a nuisance and is unlawful for any person to burn leaves, brush, grass clippings, rubbish, papers or houshold waste within the village.
   (D)   Cooking fires and camp fires are permitted, provided:
      (1)    They do not exceed two feet in diameter and three feet in height.
      (2)   They are in an approved patio device and at least ten feet from any structure and no closer than six feet from any property line.
      (3)   A responsible adult is present to control the fire at all times.
      (4)   The campfire material is wood.
      (5)   The wind velocity does not exceed ten miles per hour.
   (E)   In the event a fire department response run occurs as a result of a violation of any requirement of this section, then, regardless of whether a citation or notice of violation is issued to anyone, the property owner shall be liable for and be billed in an amount established by Dallas Township Fire Department for the charges of the fire department responding to the scene.
   (F)   The Clinton County Sheriff's Department and the Dallas Township Fire Department are authorized to enforce the provisions of this section to the extent of their respective jurisdictions.(Ord. 45, passed 9-8-03) Penalty, see § 10.99
§ 91.03 FIRE HYDRANTS: ATTACHING HOSE AND TAMPERING RESTRICTED.
   (A)   It shall be unlawful for any unauthorized person to attach a hose to any fire hydrant in the village for the purpose of sprinkling their lawns, washing automobiles, or for any purpose whatever.
   (B)   It shall be unlawful for any person to meddle or tamper with any fire hydrant except in case of a fire and then only by a recognized firefighter.

§ 91.04 STORAGE OF TRASH AND DEBRIS.
   (A)   The storage within the village of trash, garbage, or refuse in the open, or open to the air, is prohibited.
   (B)   Trash containers in the downtown business area of the village shall be covered.

§ 91.05 OUTDOOR FURNACES PROHIBITED.
   No person, corporation, partnership or entity shall install, use or maintain an outdoor furnace fired by wood, corn, pellets, coal, gas, or any other type of combustible material within the village.
