5-2-3: DISORDERLY CONDUCT:
   A.   Prohibited Acts: A person commits disorderly conduct when he knowingly:
      1.   Does any act in such unreasonable manner as to provoke, make or aid in making a breach of peace; or
      2.   Does or makes any unreasonable or offensive act, utterance, gesture or display which, under the circumstances, creates a clear and present danger of a breach of peace or imminent threat of violence; or
      3.   Refuses or fails to cease and desist any peaceful conduct or activity likely to produce a breach of peace where there is an imminent threat of violence and where the police have made all reasonable efforts to protect the otherwise peaceful conduct and activity, and have requested that said conduct and activity be stopped and explained the request if there be time; or
      4.   Fails to obey a lawful order of dispersal by a person known to him to be a peace officer under circumstances where three (3) or more persons are committing acts of disorderly conduct in the immediate vicinity, which acts are likely to cause substantial harm or serious inconvenience, annoyance or alarm; or
      5.   Assembles with three (3) or more persons for the purpose of using force or violence to disturb the public peace; or
      6.   Goes about begging or soliciting funds on any public way except where a permit has been issued by the village; or
      7.   Appears in any public place manifestly under the influence of alcohol, narcotics or other drug, not therapeutically administered, to the degree that he may endanger himself or other persons or property, or annoy persons in his vicinity; or
      8.   Carries in a threatening or menacing manner, without authority of law, any pistol, revolver, dagger, razor, dangerous knife, stiletto, knuckles, slingshot, an object containing noxious or deleterious liquid, gas or substance or other dangerous weapon or conceals said weapon on or about the person or vehicle; or
      9.   Pickets or demonstrates on a public way when such picketing or demonstration interferes with the flow of pedestrians or vehicular traffic; or (Ord. O-27-68, 5-13-1968)
      10.   Consumes alcoholic liquor in a public place or transports or carries alcoholic liquor in any public place except in the original package with the seal unbroken. (Ord. O-11-75, 9-13-1975)
   B.   Excessive Noise: The creation of excessive noise which either annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others within the village. The following acts or conduct are declared to constitute the creation of excessive noise and are hereby declared to be a nuisance and are unlawful and prohibited:
      1.   The loud playing, operating or permitting to be played or operated any phonograph, radio, television set, compact disk player, any music machine, musical instrument, loudspeaker or other machine or device for the producing or reproducing of sound which is cast upon the public streets of the village between the hours of nine o'clock (9:00) P.M. and seven o'clock (7:00) A.M.
      2.   The loud playing, operating or permitting to be played or operated any phonograph, radio, television set, compact disk player, any music machine, musical instrument, loudspeaker or other machine or device for the producing or reproducing of sound which is cast upon the public streets of the village which can be heard at a distance of one hundred feet (100') from the point of its origin between the hours of seven o'clock (7:00) A.M. and nine o'clock (9:00) P.M.
      3.   The unrestrained and prolonged barking, howling or sounds from any animal 1 .
      4.   The sounding of any horn or audible signaling device on any motor vehicle except in the event of an emergency to warn of the danger of a collision between the hours of nine o'clock (9:00) P.M. and seven o'clock (7:00) A.M.
      5.   The sounding of any horn or audible signaling device on any motor vehicle except in the event of an emergency to warn of the danger of a collision which can be heard at a distance of one hundred feet (100') from the point of its origin between the hours of seven o'clock (7:00) A.M. and nine o'clock (9:00) P.M.
      6.   The discharge of the exhaust of any internal combustion engine except through a muffler or other similar device which effectively prevents loud or explosive noises from being emitted between the hours of nine o'clock (9:00) P.M. and seven o'clock (7:00) A.M.
      7.   The discharge of the exhaust of any internal combustion engine except through a muffler or other similar device which effectively prevents loud or explosive noises from being emitted which can be heard at a distance of one hundred feet (100') from the point of its origin between the hours of seven o'clock (7:00) A.M. and nine o'clock (9:00) P.M.
      8.   Operating or permitting to operate any sound amplification system within a motor vehicle which can be heard from outside the vehicle at a distance of fifty feet (50') or more. (Ord. O-36-00, 8-14-2000)
