5-1-7: PROHIBITED ACTS AND CONDITIONS:
   A.   Disturbances 1 : It shall be unlawful for any person who owns, controls or is in possession of a dog or cat on public or private property to permit said dog or cat to bark, howl, yowl, growl, cry or make other loud or unusual noises so as to disturb the peace and quiet of persons present or residing on abutting, adjoining or neighboring property.
   B.   Removal Of Excreta: It shall be unlawful and is hereby declared a nuisance for any person having control of any dog or cat to allow such dog or cat to urinate or defecate on or upon any public street, sidewalk, parkway, playground, park area or any other property not owned by the owner or custodian thereof. The owner of every animal shall be responsible for removal and sanitary disposition of any excreta deposited by such animal in the village.
   C.   Poisoning: No person shall place, leave or expose, in any place accessible to animals whether domestic or wild, with the intent to kill or harm such animals, any poisonous substances or ingredient, unless same shall have been approved by the board of health as proper for pest control and safe for all animals other than the pests to be controlled.
   D.   Animal Fights: No person shall promote, stage, hold, manage, conduct or carry on, or be a spectator at, any animal fight or any other type of contest, game or fight of similar nature, nor any simulated version of the same that involves baiting and/or inciting an animal toward the intent to fight.
   E.   Indecent Exhibition: No person shall indecently exhibit any animal within the village.
   F.   Exhibition Of Dangerous Animals: No person shall permit any dangerous animal to be out of his control, or lead any such animal with a chain, rope or any other appliance, whether such animal be muzzled or unmuzzled, in any public way or public place within the village or upon any premises other than such person's private property.
   G.   Wild Animals:
      1.   Keeping: No person shall have, keep or maintain any wild, exotic, dangerous or nondomestic animal or reptile without first applying for and receiving from the village a permit so to do.
      2.   Disposition: All nondomesticated or wild animals which are native to the state of Illinois are the property of and under the control of the Illinois department of conservation. The Illinois department of conservation may issue permits for the keeping of wild animals or reptiles as long as such conform to the zoning requirements as set forth by the village, to the statutes of the state of Illinois and to federal law.
   H.   Cruelty To Animals: No person shall:
      1.   Have, keep or harbor any animal which is known, or believed by a licensed veterinarian to be, infected with any disease transmittable to other animals or humans, or which is afflicted with any painful disease or injury, including sever parasitism, unless such animal shall be under the care of a licensed veterinarian and so confirmed when demanded of the owner by the police department.
      2.   Overload, overdrive, overwork, beat, torture, torment, bait, mutilate or cruelly kill any animal, or cause or knowingly allow the same to be done.
      3.   Unnecessarily fail to provide any animal in his charge or custody with proper food, water, air and sanitary shelter, such shelter to be sufficient to provide natural light or artificial illumination during reasonable hours and protection from the weather, and space within sufficient limits for the animal to stand in an upright position and lie down stretched out so that no part of its body need touch any part of the structure.
      4.   Work or cruelly force into undue physical exertion any old, maimed, infirm, sick or disabled animal.
      5.   Abandon any old, maimed, infirm, sick or disabled animal or abandon any animal on any public way or in any place where it may suffer or become a public charge.
      6.   Carry, keep, drive, or cause to be carried, driven or kept, any animal in a cruel manner.
      7.   Leave for any length of time, any animal unattended in a motor vehicle or enclosed trailer when the outside temperature shall exceed seventy degrees Fahrenheit (70°F) or contain any animal in such a manner that said animal does not have proper air circulation while confined in a motor vehicle, trailer, kennel, dog house or other type of container or structure in which an animal may be confined.
      8.   Wilfully or maliciously threaten, torment, beat, kick, strike, maim, disable or kill any dog utilized by the police department of the village in the performance or function of the department; nor interfere with any such dog while being used by the police department.
