4-3-11: FOOD VENDING MACHINES:
   A.   Definition:
   FOOD VENDING MACHINE: Any mechanical container or device used for the sale, or offering for sale, of any article of food, the operation of which is governed or controlled by the deposit of a coin or token. (Village code § 15-16)
   B.   License Required: It shall be unlawful for any person to engage in the business of installing, keeping or maintaining food vending machines within the village without first having obtained a license therefor.
It shall be unlawful for any person to keep, use or permit to be used upon his premises any food vending machine, owned and operated by a person who has not obtained a license, as herein provided. Further, nothing contained in this section shall require a duly licensed purveyor or food dispenser to procure a license to operate a food vending machine. (Village code § 15-17)
   C.   Application Inspection: The village clerk shall require the execution of an application form with all of the information to be required included thereon, including the name and home address of the applicant together with the business and business address and the type of machine and place where said machine is to be installed.
The health officer shall cause an inspection to be made of the premises where said machine is to be placed and shall also inspect the food vending machines. (Village code § 15-18)
   D.   License Fee: The license fee for each food vending machine operated in the village shall be as set out in section 3-5-1 of this code. (Village code § 15-19)
   E.   Requirements: No food vending machine shall be installed or kept in any toilet or wash room. The health officer shall make periodic inspections of the place of business of the food vending machines and the articles of food purveyed therefrom. The health officer shall also see that all such equipment and food products are in a clean, sanitary and wholesome condition. (Village code § 15-20)
