(a) This chapter shall not apply and shall be of no effect if Municipal Retail and Wholesale Growers’ Market is operated by an entity other than the City of Flint, pursuant to a validly executed and legally binding lease with the City. The terms and conditions of the validly executed lease shall govern the operation of the Municipal Retail and Wholesale Growers’ Market.
(b) The Director of Purchasing, or his duly authorized representative, shall establish, by rule, the days of the week and the hours of the day that the market shall be kept open for business and he shall cause a posting of the hours and days in a conspicuous place in the market structure.
