§ 93.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code.
   (B)   (1)   Any person, corporation, firm or association who violates §§ 93.01 through 93.09 of this chapter shall be fined:
         (a)   For the first false alarm fire signal in excess of three false alarm signals in any 12- month period: $100;
         (b)   For the second false alarm signal in excess of three false alarm signals in any 12-month period: $200; and
         (c)   For the third and each successive false alarm signal in excess of three in any 12-month period: $300.
         (b)   All fines hereunder shall be paid to the Town Volunteer Fire Department within 30 days after notification of the violation. This division (B)(1)(b) shall not apply to users of a new fire alarm system during the first 90 days from the date of installation.
      (2)   (a)   If any person, firm or corporation shall violate any of the provisions of §§ 93.01 through 93.09 of this chapter, or shall do any act prohibited therein, or shall fail to perform any duty lawfully enjoined, within the time prescribed by the Fire Chief or designated representative of the Town Volunteer Fire Department, or shall fail, neglect or refuse to obey any lawful order given by the Fire Chief or his or her designated representative in connection with the provisions of §§ 93.01 through 93.09, for each such violation, failure or refusal, such person, firm or corporation shall be fined in any such sum not less than $25 nor more than $500.
         (b)   Each day of such unlawful activity as is prohibited by division (B)(2)(a) above shall constitute a separate offense.
   (C)   Anyone caught violating §§ 93.20 through 93.23 of this chapter shall be fined as set forth below. Said fine shall be in addition to any cost imposed under § 93.21 of this chapter due to the extinguishment of the fire. The fines are as follows, to wit:
      (1)   First offense: $12.50;
      (2)   Second offense: $25;
      (3)   Third offense: $50; and
      (4)   Subsequent offenses: $20 times the number of offenses committed by the person, including the first three offenses.
   (D)   Any person or persons violating any of the provisions of § 93.35 of this chapter shall, upon his or her conviction before any Justice of the Peace of said town or any court of competent jurisdiction, be fined in any sum not to exceed $10 for each offense.
   (E)   Any person who shall violate any or either of the provisions of §§ 93.50 through 93.59 of this chapter or any section or clause thereof, or who shall fail or refuse to comply with any of the requirements or to perform any of the duties herein required of him or her, shall, on conviction, forfeit and pay to the town a fine not less than $1 nor more than $10. Each and every day any person shall continue any such violation or fail or refuse to comply with any such requirements shall be deemed and taken to be a separate offense.
