610.10  AUTHORITY OF AIR POLLUTION HEARING BOARD.
   (a)   A five man Air Pollution Hearing Board shall be appointed as provided for in Section 610.11 or Section 610.12. Because air pollution prevention is a metropolitan problem and because the Village is a member of the Metropolitan Air Pollution Control Program, it shall be deemed proper to have the same Air Pollution Hearing Board serve all municipalities that are members of the Metropolitan Air Pollution Control Program.
   (b)   The Board shall be empowered to act as follows:
      (1)   To hear appeals from rulings or orders of the Air Pollution Control Officer as provided for in Section 610.13;
      (2)   To act in the matter of emission testing as provided for in Section 610.09;
      (3)   To determine a reasonable time for compliance as provided for in Section 610.04.
   (c)   The appointed membership shall serve a term of five years except that of initial members, one shall be appointed for one year, one for two years, one for three years, one for four years and one for five years.
   (d)   The members shall be persons of good reputation and when appointed, shall reside or be employed within the communities contracting with the City of Cincinnati for air pollution control services or within the City of Cincinnati.
   (e)   One member shall be a registered professional engineer, one member shall be a practicing chemist or chemical engineer, one member shall be a representative of industry or manufacturing enterprise, one member shall be a lawyer and one member shall be selected at large for his interest in accomplishing the objectives of this chapter.
   (f)   The Board shall elect its own Chairman. Meetings of the Board shall be held at the call of the Chairman and at such other times as the Board may determine. The Board shall have the power to adopt and enforce such rules and regulations as it may deem necessary for the conduct of its business as defined in divisions (a), (b) and (c) of this section. The Board shall hake the authority to collect appeal fees provided for in Section 610.06 and to disburse funds to defray the cost of clerical or other services incurred by the Board for the conduct of its business. The members shall serve without compensation. Three members shall constitute a quorum.
