610.09  PROVISIONS FOR TESTING EMISSIONS.
   (a)   Whenever the Air Pollution Control Officer, after reasonable investigation, determines that any chimney, vent or other source is suspected of being in violation of any of the provisions of this chapter, he may, with the approval of the Air Pollution Hearing Board, require a test to be made of the suspected source. When it is determined that a test shall be made, the owner or person in control of the suspected source shall make provisions for and pay all the costs of making such tests. The testing procedure shall be mutually agreed to by the person of whom the test is required and the Air Pollution Control Officer in advance of conducting the test. If the testing procedure cannot be mutually agreed upon, the Air Pollution Hearing Board shall designate a qualified person to establish the testing procedure.
   (b)   When the results of the test prove that the suspected source is not in violation of any of the provisions of this chapter, the owner or person in control of the suspected source shall be exempt from bearing the costs of such test and shall be reimbursed by the Village for such costs, when such test was made by persons outside the employ of the owner or person in control of the suspected source.
