610.06  AIR CONTAMINANTS OF EQUIVALENT OPACITY.
   (a)   (1)   Any air contaminant of such opacity as to obscure an observer's view to a degree equal to or greater than does dense smoke as defined in Section 610.05, is hereby declared a nuisance and the escape thereof from any pipe, chimney or vent or from any other source for a period or periods aggregating more than three minutes in any one hour shall be unlawful.
      (2)   An emission of such opacity as is described in this section shall not be deemed a nuisance and unlawful if such opacity is due to the condensation of water vapors containing emitted particulate matter not in excess of 0.49 grains air contaminant per standard cubic foot of emission.

   (b)   Whoever violates this section is guilty of a misdemeanor of the fourth degree. Punishment shall be as provided in Section 698.02.
