The Building Commissioner and the Health Commissioner may determine that any section of the Health and Sanitation Code or this Building and Housing Code may be made responsible for the enforcement of any particular section or sections of this Code. However, the Building Commissioner and the Health Commissioner shall jointly be responsible for the enforcement of the provisions of this Code except where such responsibility is expressly vested in only one.

The Building Commissioner shall have the power to make such rules and regulations as may be necessary for carrying out the provisions of this Code. Such rules and regulations shall be in writing, shall be available to the public for inspection, and shall be published in at least three issues of a daily newspaper circulated in the City, before they become effective.

If an owner fails to comply with the provisions of this Code, then the Building Commissioner may take such action as may be necessary to remedy the condition, at the expense of the owner of the structure. The Building Commissioner shall submit bills for the cost thereof to the owner of the structure, and if these bills are not paid, the Building Commissioner shall certify the amount due to the Finance Director, who shall have such bills placed on the tax duplicate.

The Building Commissioner shall, upon authority of Council, secure three bids from three reputable contractors. Upon receipt of these bids, the Board of Control shall award the contract to the lowest and best bidder, provided, however, that the Board of Control shall have full power and authority to reject any and all bids.

(a) Authority. The Planning and Zoning Commission shall have jurisdiction to hear and decide appeals where it is alleged that there is error in any order, requirement, decision or determination made by the Building Commissioner or the Health Commissioner in the enforcement of this Code in accordance with the provisions of Section 1301.07 of the Planning and Zoning Code.
(b) Procedure. Appeals may be taken to the Commission by any person aggrieved by any decision of the Building Commissioner or Health Commissioner. Such appeal shall be taken within thirty days after the decision is rendered by filing with the Building Commissioner a notice of appeal specifying the grounds therefor. The Building Commissioner or Health Commissioner shall forthwith submit to the Commission a copy of this notice of appeal together with all the papers constituting the record upon which the action appealed from is taken.
(c) Powers Additional to Those Granted by Other Ordinances. The powers granted hereunder to the Planning and Zoning Commission shall be in addition to those conferred upon it by other ordinances of the City.
(d) Judicial Review. Any person or persons jointly or severally aggrieved by a decision of the Commission, including any official, department, division, bureau, board or commission of the City, shall be entitled to a judicial review of the decision rendered by the Commission as provided in these Codified Ordinances or in State law.
