1701.06 APPLICATION TO BUILDINGS UNDER CONSTRUCTION.
   Buildings under construction for which permits were secured prior to the effective date of this Code may be completed in conformity with such permits.

1701.07 APPLICATION TO EXISTING BUILDINGS.
   (a)   General. Except as otherwise specifically provided, additions, alterations or repairs to buildings or other structures shall comply with all the requirements for new buildings and structures. When the provisions of this Code do not specifically require changes or alterations in existing buildings or other structures, buildings and other structures lawfully existing, used and occupied on the effective date of this Code may be continued in such use or occupancy without change or alterations except as may hereafter be deemed necessary in the interests of public health, safety and welfare.
   (b)   Change in Use or Occupancy. When the use or occupancy of a building or other structure is changed to one subject to more restrictive requirements, the entire building or other structure shall be made to conform with such more restrictive requirements as they apply to new buildings and other new structures.
   (c)   Additions. When an addition is made to an existing building or other structure, which existing building or other structure does not meet the construction requirements for new buildings and new structures, an approved fire separation shall be provided between such building or other structure and the addition.
   (d)   Major Alterations and Repairs. When the cost of alterations or repairs within any two-year period exceeds fifty percent of the value of an existing building or other structure, such building or other structure shall be made to comply with the requirements for new buildings and other new structures.
   (e)   Structural Alterations and Repairs. Any alteration or repair to the structural portion of an existing building or other structure shall be made in conformity with the requirements for new buildings and other new structures.
   (f)   Repairs to Roof Covering. Not more than twenty-five percent of the roof covering of any building or structure shall be replaced in any two-year period unless the entire roof covering is made to conform with the requirements for roof covering on new buildings and other structures.
   (g)   Building Moved Into the City. Buildings or other structures moved into or within the City shall conform to the requirements for new construction in the location to which they are moved.

   (h)   Construction of Ramps for Disabled. Ramps shall not have a gradient of less than 1:12 and shall have non-slip surfaces. Ramp width shall be not less than four feet with a four feet by four feet platform at its highest point. There shall be no less than a six square foot level surface at the bottom of the ramp. All ramps shall be constructed with appropriate hand rails. However, where the ramp is constructed for public use, it shall include one set of hand rails 24 inches high and one set of hand rails 36 inches high. At each point at which a ramp changes direction there shall be not less than a four feet by four feet platform. Ramps in excess of 30 feet shall have a level not less than a four square foot surface at the 30-foot point. Any ramp should be installed in the rear yard whenever a rear entrance to the dwelling exists.
   Permits shall be secured as required by Chapter 1703 of these Codified Ordinances, except that applicable fees shall be waived. Technical assistance in the construction of ramps may be provided by the Department of Planning and Development upon request. The Architectural Review Board may, at the request of the Building Commissioner, review and approve plans.

1701.08 ESTABLISHING PROPORTIONATE VALUE OF DESTROYED PART, AND OF ADDITIONS, ALTERATIONS AND REPAIRS.
   In determining proportionate value of a destroyed part of a building or other structure, or of additions, alterations or repairs made to a building or other structure, all parts, whether existing, new or destroyed, and including plumbing, heating and ventilating equipment, electrical wiring and equipment, and other necessary fixed equipment, shall be valued at costs current at the time of evaluation, provided, however, that parts which do not serve a required purpose such as decorative painting, molded or cast plaster decorations, and wall, floor or ceiling finishes intended for comfort or enhancement, shall not be included in such evaluation.

1701.09 ZONING.
   No provision of this Code shall be interpreted to modify or change any part of a zoning ordinance, rule or regulation of this City.

1701.10 MAINTENANCE.
   All buildings or structures, both existing and new, and all parts thereof, shall be maintained in a safe and sanitary condition. All devices or safeguards which are required in a building when erected, altered or repaired, shall be maintained in good working order. The owner shall be responsible for the maintenance of buildings and structures.

1701.11 MATERIALS AND METHODS OF CONSTRUCTION.
   Nothing in this Code shall be construed to prevent the use of any material or method of construction, if upon presentation of construction documents, methods of analysis, test data or other essential information to the Code Official by the applicant, the Code Official is satisfied that the proposed material or method of construction conforms with the intent of this Code.
   The storing of fill or materials of any kind on the tree lawn is prohibited, except that flagstone removed from the sidewalk may be laid flat on the tree lawn but shall be kept at least four feet from any tree.
   Sidewalks shall be kept free and passable at all times and the driveway crossing over the sidewalk shall be leveled and repaired at the end of each day.
   All papers from building materials, lunch wrappings and bottles must be picked up and disposed of at the end of each day to prevent papers from blowing on adjoining properties or onto the street.
   Trenches in tree lawns or adjoining sidewalks shall be filled to grade level by the end of each day, or shall be protected with substantial barricades if left overnight. Trenches through sidewalks are prohibited except by specific permission of the Building Commissioner. In any such case, the trench shall be backfilled before the end of the day, or shall be bridged and protected by guard rails.
   Upon violation of any of the above regulations, it shall be the duty of the Building Commissioner to notify the owner or owners, or his, her or their agent, in writing or by posting a notice on the premises, of such violation and that all work for which the building permit was issued must be suspended on the premises until the requirements of this section have been fulfilled. After such notice has been given no person shall do any construction work on such premises until the violations for which the notice was issued have been corrected. The Administrative Director may, without notice, correct any condition endangering public safety in the streets or on the sidewalk and charge the expense thereof against the permit deposit provided elsewhere in this Building Code.

1701.12 OPERATIONS, SAFETY AND NUISANCES.
   (a)   All reasonable safety precautions shall be taken during the construction, demolition or removal operations including, but not limited to the bracing of the structures, erecting barricades and scaffolds, and posting warning signs.
   (b)   Access to fire hydrants and fire department fire sprinkler connections shall be maintained at all times.
   (c)   Sufficient temporary means of egress shall be provided in all occupied buildings or structures undergoing alterations, additions or repairs.
   (d)   Excavations shall be properly supported to protect adjoining properties.
   (e)   The public right-of-way and adjoining properties shall be protected from falling debris.
   (f)   Except as authorized by the Director of Public Service, the sidewalks shall be kept free and passable at all times. No scaffolding or equipment shall occupy the public right-of-way without the permission of the Director of Public Service. Any use of the public right-of-way shall be in conformance with the standards of the Director of Public Service.
   (g)   The property shall be secured during periods of time where no work is being conducted.
   (h)   Dusts generated by demolition or removal operations shall be controlled by approved methods.
   (i)   The construction of temporary driveways or other precautions shall be taken to prevent mud from being tracked into the street. Temporary driveways shall be constructed of a coarse stone or other approved material to a depth sufficient to provide a substantial base, and shall extend as far as necessary to prevent the tracking of mud into the right-of-way.
   (j)   Adequate toilet facilities shall be provided for workers.
   (k)   All vehicles shall be parked in legally authorized locations.
