1174.06 SIGNS PERMITTED IN ALL DISTRICTS WITHOUT A PERMIT.
   The following signs may be displayed in all zoning districts without a permit subject to all the provisions of this chapter:
   A.   One (1) plaque, nameplate or tablet denoting the name of the building and/or date of erection the total area of which shall not exceed two (2) square feet per sign face.
   B.   Directional or informational signs shall not exceed eight (8) square feet per sign face.
   C.   Official, Federal, State or local government signs, flags, emblems, and historical markers.
   D.   Holiday or special event decorations subject to the provisions of this chapter.
   E.   Temporary signs unless otherwise provided by this chapter, shall be placed, erected or displayed subject to the following conditions:
      1.   Any such temporary sign shall be placed, erected or displayed on the same lot to which it is an accessory use and shall be located no closer than five (5) feet from the right-of-way.
      2.   No temporary sign shall be illuminated.

      3.   No temporary sign, including special event signs, except real estate and construction signs, shall be displayed longer than twenty (20) days. Special event signs shall not be displayed, erected or placed more than seventeen (17) days prior to the special event and shall be removed within two (2) days following said special event. Real estate signs shall be removed within thirty (30) days after the property is sold (transfer date) or rented. Construction signs shall be removed within thirty (30) days after the construction has ceased.

      4.   No temporary sign in any R-LD, R-MD, R-UD, or R-TH District shall exceed eight (8) square feet per sign face. No temporary sign in any other district shall exceed thirty-two (32) square feet per sign face.
      5.   Signs designed to be moved on trailer wheels, skids or similar devices shall not be permitted as temporary signage.
   F.   Public notices or information signs identifying telephones, rest rooms and similar facilities, not to exceed two (2) square feet per sign face. Advertising matter is not permitted on such signs.
   G.   Incidental signs.
   H.   Any sign relating to an emergency which poses an imminent threat to human life or property.

1174.07 RESIDENTIAL DISTRICTS.
   A.   No permit is required to place, erect or display any sign permitted under Section 1174.06 in residential districts, except that no sign shall be placed or displayed which advertises or promotes goods or services.
   B.   A permit is required to place, erect or display any of the following signs in all residential zoning districts:
      1.   Subdivision identification sign.
         a.   One ground mounted, wall or painted sign.
         b.   The maximum area of such sign shall be thirty-two (32) square feet per sign face, not to exceed a maximum area of sixty-four (64) square feet.
         c.   The maximum height of a ground mounted sign shall be six (6) feet.
         d.   Such sign shall be located on private property at the dedicated street entrance of the development no closer than five (5) feet from the right-of-way.
      2.   Institutional sign.
         a.   One ground-mounted, wall or painted wall sign.
         b.   The maximum area shall be thirty-two (32) square feet per sign face, not to exceed a maximum area of sixty-four (64) square feet.
         c.   The maximum height of a ground mounted sign shall be six (6) feet.
         d.   Such sign shall be placed or erected on the same lot to which it is an accessory use no closer than five (5) feet from the right-of-way.
      3.   Multi-household dwelling or boarding house sign.
         a.   One ground-mounted, wall or painted wall sign.
         b.   The maximum height shall be six (6) feet.
         c.   The maximum area of any ground-mounted shall be thirty-two (32) square feet per sign face, not to exceed a maximum of sixty-four (64) square feet.
         d.   The multi-household sign shall be located at the dedicated street entrance no closer than five (5) feet from the right-of-way.

1174.08 DOWNTOWN COMMONS AREA.
   A.   No Permit Required.
   No permit is required to place, erect or display the following signs or apparatus in the Downtown Commons Area, but all signs or apparatus must be in conformance with the regulations of this chapter and all other requirements set forth in this Code:
      1.   Signs permitted under Section 1174.06.
      2.   Special event apparatus, such as banners, balloons, posters and similar devices, with the approval of the Building Inspector, may be displayed, erected or placed not more than ten (10) days prior to the special event and shall be removed within two (2) days following said special event. The Building Inspector may disapprove special event apparatus if such do not meet the requirements of Sections 1174.03 and 1174.05.
      3.   Awning signs, the area of which shall be included in the maximum sign area permitted per premises.
      4.   Incidental signs not to exceed two (2) square feet per sign face per tenant space, the area of which shall be included in the maximum sign area permitted per premises.

   B.   Permit Required.
   A permit is required to place, erect or display the following signs in the Downtown Commons Area. However, the total sign area shall not exceed one hundred twenty-five (125) square feet in cumulative area per premises. Sign types and sizes are permitted as follows, except as provided in Section 1174.08 (A)(2)(a):
      1.   One (1) ground mounted sign per premises not to exceed two (2) square feet in sign area for each linear foot of main street frontage, up to a maximum of forty-eight (48) square feet. Such sign shall not exceed a height of nine (9) feet. No part of any freestanding sign shall extend over any public sidewalk or public street, or part thereof.
      2.   Two (2) painted wall signs or wall signs per tenant space, not to exceed two and one-half (2-1/2) square feet in sign area for each linear foot of that occupancy's building frontage, up to a maximum of one hundred twenty-five (125) square feet, except as provided in Section 1174.08 (A) (2) (a).
      3.   One (1) under-canopy sign per tenant space, not to exceed four (4) square feet in sign area, the area of which shall not be included in the maximum area permitted.
      4.   One (1) non-illuminated projecting sign per tenant space, not to exceed three (3) square feet per sign face.
   C.   Supplementary Regulations for the Downtown Commons Area.
   The following supplementary regulations shall apply to all signage within the Downtown Commons Area:
      1.   Each sign erected, hung or suspended and which extends over and across any public sidewalk, public street or part thereof, shall not extend out from the building or structure upon which the sign is erected, suspended or hung a distance greater than eight (8) feet, nor in any event, except as hereinafter provided, to a point nearer than three (3) feet from any curb line extended vertically. No such sign shall be erected so as to have less than eight (8) feet of vertical clearance between such sign and the public sidewalk or way over which sign is suspended, erected or hung; however, this provision shall not apply to signs erected upon, but not suspended from, any marquee, in which case the sign may extend to within three (3) feet of the curb line of the street.
      2.   Additional wall signs or painted wall signs shall be permitted at the rate of three percent (3%) of the exposed surface area of each side or rear wall up to a maximum of one hundred fifty (150) square feet per additional face.
      3.   On a corner lot one additional wall sign or painted wall sign and additional canopy, under-canopy, awning and marquee signs shall be permitted on the additional frontage, not to exceed the size limitations of other allowed wall and painted wall signs.
      4.   All signs shall conform to Ohio law regarding copy and use of symbols on the sign face.
   D.   Nonconforming Signs.
   Any sign that lawfully exists at the time of the passage of this chapter which would not be permitted by these regulations is a nonconforming sign. All nonconforming signs must be removed not later than April 15, 2002.
      1.   A nonconforming sign shall not be enlarged or altered in any way which increases its nonconformity, but a sign or portion thereof may be altered to decrease its nonconformity.
      2.   A nonconforming sign shall not be replaced or reconstructed unless it conforms to the regulations of this section, except that the message of a nonconforming sign which contains a painted, papered or changeable copy sign (manual) may be changed.
   E.   Prohibited Signs.
   The following types of signs are prohibited in the Downtown Commons Area, in addition to the prohibitions found in Section 1174.03:
      1.   Banners, pennants, festoons and searchlights, except as allowed in Section 1174.08(A)(2)(a).
      2.   Signs which advertise goods or services and are placed on vehicles or trailers which are parked or located for the primary purpose of displaying said sign (this does not apply to signs or lettering on buses, taxis or other vehicles operating during the normal course of business).
      3.   Off-premises signs (billboards).
      4.   Signs placed or displayed on a building wall to advertise goods or services not pertaining to the permitted use conducted on the premises.
      5.   Roof signs and portable signs.
      6.   Any illuminated sign lighting device that does not emit light of constant intensity, or which contains a flashing, intermittent or moving light or lights (this does not apply to an automatic changeable copy sign).

1174.09 PROFESSIONAL OFFICE DISTRICT (POD).
   A.   No permit is required to place, erect or display the following signs in the POD:
      1.   Signs permitted under Section 1174.06.
      2.   Awning signs.
   B.   A permit is required to place, erect or display the following signs in the POD:
      1.   One ground mounted sign to identify the professional office to be used by all occupants in the professional office complex.
         a.   The maximum area shall be twenty (20) square feet per sign face, not to exceed a maximum sign area of thirty-two (32) square feet.
         b.   The maximum height shall be five (5) feet.
         c.   The sign shall be placed or erected on the same lot to which it is an accessory use no closer than five (5) feet from the right-of-way.
      2.   One wall sign, painted wall sign, marquee sign, under-canopy sign or projecting sign per tenant space in the professional office complex.
         a.   The maximum height shall be no higher than the wall or structure on which it is erected.
         b.   The maximum area permitted for a wall, painted wall, marquee or under-canopy sign shall be six (6) square feet per sign face per tenant space.
         c.   The maximum area permitted for a projecting sign shall be three (3) square feet per sign face per tenant space.
      3.   On a corner lot, one additional wall sign or painted wall sign and additional canopy, under-canopy, awning and marquee signs shall be permitted on the additional frontage, not to exceed the size limitations of other allowed wall and painted wall signs.
      4.   All signs shall conform to Ohio law regarding copy and use of symbols on the sign face.

1174.10 B-N DISTRICT.
   A.   No permit is required to place, erect or display signs permitted under Section 1174.06 in the B-N District.
   B.   A permit is required to place, erect or display the following signs permitted under Section 1174.06 in the B-N District:
      1.   Institutional signs.
         a.   One (1) ground-mounted wall or painted wall sign.
            (1)   The maximum area of the sign shall be thirty-two (32) square feet per sign face.
            (2)   The maximum height of the ground mounted sign shall be six (6) feet.
         b.   Such sign shall be located on the same lot to which it is an accessory use and shall be located no closer than five (5) feet from the right-of-way.
      2.   Business signs.
         a.   One (1) ground mounted sign to identify the business or center to be used by all tenants occupying the premises.
            (1)   The maximum height of a ground mounted sign shall be nine (9) feet with a maximum area of thirty (30) square feet per sign face, not to exceed a maximum area of sixty (60) square feet.
            (2)   Such sign shall be located on the same lot to which it is an accessory use and shall be located no closer than five (5) feet from the right-of- way.
         b.   One wall, painted wall or awning sign per tenant space.
            (1)   The maximum height of a wall, painted wall, or awning sign shall be no higher than the wall on which it is erected, with a maximum area of 2.5 square feet per linear foot of building frontage, up to a maximum of thirty (30) square feet per sign face.
            (2)   Such sign shall not project more than fifteen (15) inches from the building wall.
         c.   One marquee sign with a maximum area of six (6) square feet per sign face per tenant space.
         d.   One projecting or under-canopy sign with a maximum area of three (3) square feet per sign face, not to exceed six (6) square feet per tenant space.
      3.   Signs on corner lots.
   On a corner lot one additional wall sign or painted wall sign and additional canopy, under-canopy, awning and marquee signs shall be permitted on the additional frontage, not to exceed the size limitations of other allowed wall and painted wall signs.
      4.   Conformity with State law.
   All signs shall conform to Ohio law regarding copy and use of symbols on the sign face.

1174.11 BUSINESS-DOWNTOWN DISTRICT (B-D).
   A.   No permit is required to place, erect or display signs permitted under Section 1174.06 in the B-D District.
   B.   A permit is required to place, erect or display the following signs in the B-D District:
      1.   Business signs.
         a.   One (1) ground-mounted sign to identify the business or center to be used by all tenants occupying the premises.
            (1)   The maximum height of a ground mounted sign shall be nine (9) feet with a maximum sign area of forty-eight (48) square feet.
            (2)   Such sign shall be placed or erected on the same lot to which it is an accessory use no closer than five (5) feet from the right-of-way.
         b.   One wall or painted wall sign, awning sign or marquee sign per tenant space. The maximum height of a wall, painted wall, marquee or awning sign shall be no higher than the wall on which it is erected, with a maximum sign area of 2.5 square feet per lineal foot of lot frontage, up to a maximum area of forty-eight (48) square feet per tenant space.
         c.   One projecting sign or under-canopy sign with a maximum area of three (3) square feet per sign face, not to exceed a maximum area of six (6) square feet.
      2.   Signs on corner lots.
   On a corner lot, one additional wall sign or painted wall sign and additional canopy, under-canopy, awning and marquee signs shall be permitted on the additional frontage, not to exceed the size limitations of other allowed wall and painted wall signs.
      3.   Conformity with State law.
   All signs shall conform to Ohio law regarding copy and use of symbols on the sign face.

1174.12 BUSINESS-GENERAL (B-G), BUSINESS-AUTOMOTIVE (B-AO), LIGHT-INDUSTRIAL (L-I), HEAVY-INDUSTRIAL (H-I), AND SPECIAL-INDUSTRIAL DISTRICTS (S-I).
   A.   No permit is required to place, erect or display the following signs in the B-G, B-AO, L-I, H-I and S-I Districts:
      1.    Signs permitted under Section 1174.06.
      2.   Festoons.
   B.   A permit is required to place, erect or display the following signs in the B-G, B-AO, L-I, H-I and S-I districts:
      1.    Business signs.
         a.   One (1) ground-mounted sign to identify the business or center to be used by all tenants occupying the premises.
            (1)   The maximum height of a ground-mounted sign shall be nine (9) feet, the maximum area shall be forty-eight (48) square feet per sign face, and the total area shall not exceed sixty-four (64) square feet.
            (2)   Such sign shall be placed or erected on the same lot to which it is an accessory use no closer than five (5) feet from the right-of-way.
            (3)   Free standing signs are prohibited for Sexually Oriented Business.
         b.   Any combination of three (3) wall, painted wall, projecting, awning, marquee, or under-canopy signs per tenant space shall be permitted.
            (1)   The maximum area of such signs, collectively, shall be three (3) square feet per lineal foot of building width.
            (2)   The maximum height of such signs shall be no higher than the wall to which they are fastened.
         c.   All signs for Sexually Oriented Businesses shall be "wall signs" as defined in Section 1174.02, with a maximum allowable sign area of fifty (50) square feet and measured in accordance with the standards and specified in Section 1174.02, and shall not be internally illuminated.
      2.   Subdivision identification signs.
         a.   One (1) ground-mounted, wall or painted wall sign.
         b.   The maximum area of such sign shall be thirty-two (32) square feet per sign face, not to exceed a total area of sixty-four (64) square feet.
         c.   The maximum height of a ground mounted sign shall be nine (9) feet.
         d.   Such sign shall be located on private property at the dedicated street entrance of the development and shall be located no closer than five (5) feet from the right-of-way.
      3.   Signs on corner lots.
         On a corner lot one additional wall sign or painted wall sign and additional canopy, under-canopy, awning and marquee signs shall be permitted on the additional frontage, not to exceed the size limitations of other allowed wall and painted wall signs.
