1361.06 FENCES PERMITTED IN ONE-FAMILY, MULTI-FAMILY AND SUBURBAN "1" DISTRICTS.
   (a)   In One-Family, Multi-Family and Suburban “1” Districts a fence not exceeding six feet in height may be located in any rear yard subject to restrictions in subsection (b) hereof.
   (b)   (1)   Front side yard. As used in this section, “side yard portion of a front yard” means all lands adjacent to the front yard and extending backward to the front setback of any dwelling.
      (2)   Rear side yard. As used in this section, “Side year portion of a rear yard” means all lands adjacent to the rear yard and extending forward to a point at the front setback of any dwelling.
      (3)   In the front yard and/or the front side yard, no fence shall be erected except as an ornamental fence as defined in Section 1361.02(b).
      (4)   In the rear side yards and/or the side portions of back yards which abut a street, no fence may be erected with a height greater than forty-eight inches and must provide reasonable pedestrian and/or traffic visibility for the first fifteen feet of any driveway and/or the first thirty feet of any roadway or public thoroughfare. A fence may be no closer than six inches to any property line which abuts a street or public right of way. The main dwelling with an attached garage and/or has 40’ feet or more of distance from an adjacent property located on a corner of two public thoroughfares or any roadways, may have a fence to a maximum height of six feet providing that pedestrian and/or traffic visibility is maintained as determined by the Chief Building Official or one of his/her delegates.
