1361.02 DEFINITIONS.
   As used in this chapter:
   (a)   “Fence” means a predominantly vertical and continuous structure or device intended to enclose, confine or delineate an otherwise open area of land. Hedges, trees, bushes, shrubs and plants or ornamental fences are not included within the meaning of the word “fence.”

   (b)   “Ornamental fence” means a vertical or horizontal or vertical/horizontal combination and continuous structure or device intended primarily for ornamentation and not for confining an area or located not closer to any public right of way than three feet, and constructed in a manner so as to conform to the following. Maximum height of such fence from ground surface along which the fence is erected, to the top of the highest rail shall be thirty-six inches and to the top of any post forty-two inches.
