The following license taxes or fees are levied respectively and for the duration of time as indicated in each case:
Circuses, carnivals, skating rinks and exhibitions for which an admission is charged: Twenty five dollars ($25.00) per day of operation, payable in advance of opening.
Hawkers, peddlers of goods (except sellers of vegetables and produce which they produced), wares or any other merchandise of whatever nature or other itinerant merchants: Five dollars ($5.00) per day, twenty five dollars ($25.00) per month or one hundred dollars ($100.00) per year.
Solicitation of subscriptions for books, magazines or other literary products where all or a part of the price is collected at the time of the subscription: Five dollars ($5.00) per day per individual so selling or taking subscriptions.
Vehicles or taxicabs for hire: Twenty five dollars ($25.00) per year per vehicle.
Coin operated devices operated by the deposit of a coin or coins for dispensing of a service or a product as follows:
For each coin operated amusement device: Twenty five dollars ($25.00) per year.
For each coin operated vending device requiring the deposit of twenty five cents ($0.25) or more: Twenty five dollars ($25.00) per year.
For each coin operated vending device requiring the deposit of less than twenty five cents ($0.25): Seven dollars fifty cents ($7.50) per year.
For each coin operated bulk vending device which vends one to five (5) products through a single distribution mechanism requiring the deposit of a coin or coins having a value of twenty five cents ($0.25) or more: Three dollars seventy five cents ($3.75) per year.
For each coin operated bulk vending device which vends one or more products through multiple distribution mechanisms requiring the deposit of a coin or coins having a value of twenty five cents ($0.25) or more: Ten dollars ($10.00) for each five (5) distribution mechanisms or any number less than five (5) mechanisms. This number shall be determined by dividing the total number of mechanisms by five (5) and, if a fractional number results, the number of permits shall be rounded up.
For each coin operated bulk vending device requiring the deposit of a coin or coins having a value of less than twenty five cents ($0.25): One dollar fifty cents ($1.50) per year.
These annual fees shall be in lieu of sales taxes which are not collected on these purchases.
Exemptions: The following coin operated devices shall be exempt from the provisions of this section:
All coin operated devices owned or operated by and located on the premises of a public or private school, a church or a governmental entity;
All coin operated devices which dispense newspapers or periodicals;
All coin operated devices which dispense only postage stamps;
All coin operated devices which dispense water at laundromats or car washes.
Permit stamps shall be issued for one calendar year, however permit stamps issued in the second half of the year shall be prorated fifty percent (50%). Any items sold through a vending machine for which the permit stamp has been paid and is displayed shall be exempt from and not subject to sales tax.
Any owner or operator of a coin operated device who places such device in service and available to the public without first affixing said permit stamp shall be guilty of an offense and shall be liable upon conviction for a fine of seventy five dollars ($75.00) plus court costs and the costs of the permit stamp for each nonpermitted device.
Where any coin operated device as previously defined is placed on location within the city of Drumright without a permit stamp affixed as provided by this section, the device, including any cash in the receptacle thereof, shall be considered forfeited to the city of Drumright and may be seized by any law enforcement officer and impounded subject to a hearing in the Drumright municipal court. The owner thereof shall be given a minimum of ten (10) days notice of the time and date of the hearing. At the conclusion of the hearing, the municipal court judge shall enter a finding and upon a finding of guilty, the owner shall pay the above referenced fine and costs whereupon the city of Drumright shall return the device(s) to the owner.
