7-4-1: DRAINAGE OF STREETS AND ALLEYS:
   A.   Duty Of City To Maintain: It shall be the duty of the street superintendent and the street department to maintain at all times adequate curbs and/or drainage ditches along the sides of the traveled portions of all streets, avenues and alleys within the corporate limits of the city. In connection with this duty, the city shall have the right to use all or any portion of the dedicated width of such street, avenue or alley and may use whatever reasonable means are necessary in order to maintain such drainage for the protection of the surface and general condition of said streets.
   B.   Property Owner Responsibilities: All property owners shall have the duty to fully cooperate with the street department of the city in maintaining proper drainage for streets and alleys; and it shall be the duty of all property owners to purchase and install in the manner prescribed by the street superintendent and under his supervision, any necessary drainage pipe, bridge, culvert or other item of equipment or construction necessary to maintain proper drainage alongside any property owned.
   C.   Nonliability Of City: The city shall have no liability to any property owner for any change made or property removed or destroyed in the process of reasonably creating and maintaining proper drainage of the streets and alleys of the city. (1980 Code § 19-44)
