5-13-19-5: TEMPORARY LICENSE FOR SALE AT DIXON RIVERFRONT/HERITAGE CROSSING:
   (A)   Issuance Of License:
      1.   Subject to the terms and conditions of this chapter, the local liquor control commissioner is hereby authorized to issue a license to any person or entity for the sale, transfer or giving away of alcoholic liquor in the public area commonly known as the Dixon Riverfront/Heritage Crossing.
      2.   Each application for a license under this chapter shall include a certificate of insurance evidencing dramshop insurance and a certificate of insurance evidencing public liability insurance in an amount not less than fifty thousand dollars ($50,000.00) for any one person or one hundred thousand dollars ($100,000.00) for any one accident. Said certificates of insurance shall name the city of Dixon, its city council, officers, agents and employees of the city, and the riverfront commission as an additional insured.
   (B)   Restrictions On Locations:
      1.   The license issued pursuant to this section may be issued for use only at the public area owned by the city of Dixon and commonly known as the Dixon Riverfront/Heritage Crossing. (Ord. 2796, 10-4-2010)
      2.   Any license authorized under subsection (A) of this section shall not be issued without the applicant first having entered into a lease agreement with the Dixon riverfront commission (or its successor if the city has authorized any other entity to assume the day to day operations and management of the Dixon Riverfront/Heritage Crossing).       3.   The sale, transfer and consumption of alcoholic liquor shall be confined to the area defined in said lease, and the defined area must be enclosed by fencing. The location, composition, design and construction of the fence shall be approved by the mayor. No alcoholic liquor may be removed from the enclosed area.
      4.   If alcoholic liquor is to be sold from the proposed licensed area, the application must be countersigned by the holder of a valid liquor license issued under sections 5-13-3 and 5-13-5 of this chapter. In such case, the restrictions on the type of alcoholic liquor that may be sold under the holder's liquor license shall be applicable. (Ord. 2796, 10-4-2010)
   (C)   Restriction On Period And Time Of Sale Of License: The license issued under subsection (A) of this section shall be issued for one day only and for a length of time as determined by the local liquor control commissioner. Provided, however, under no circumstances shall alcoholic liquor be sold, delivered, transferred, distributed or given away in the licensed area at times other than as provided for in section 5-13-9 of this chapter or on Sundays from eight o'clock (8:00) A.M. to eleven o'clock (11:00) P.M.    (D)   Restrictions On Sale Or Transfer:
      1.   No person under the age of twenty one (21) shall purchase, attempt to purchase, possess or consume any alcoholic liquor upon the licensed area.
      2.   No alcoholic liquor served in an open container may be removed from the licensed area.
      3.   No sales or dispensing of alcoholic liquor may be made from the licensed area to any person upon an adjoining property, public street, sidewalk or alley.
      4.   Any license granted pursuant to this chapter may contain such other restrictions as the local liquor control commissioner deems warranted to protect the use and enjoyment of the area and of adjacent properties.
      5.   Adequate security must be provided by applicant. (Ord. 2796, 10-4-2010)
   (E)   Restriction Of Riverfront Commission: The Dixon riverfront commission (or its successor if the city has authorized any other entity to assume the day to day operations and management of the Dixon Riverfront/Heritage Crossing) shall establish rules, regulations, and restrictions governing use of the area to be licensed.    (F)   Fee: The total fee for the license shall be one hundred dollars ($100.00).
   (G)   Violation: Any violation of this chapter shall also constitute grounds for the suspension or revocation of the liquor license if the applicant is also a license holder under this chapter.
   (H)   Suspension And Termination: The mayor or the chief of police shall have the authority to immediately terminate or revoke the license granted under this section if the mayor or the chief of police believes such action is necessary to prohibit the disturbing the peace of others, to terminate offensive conduct, or to protect the health, safety and welfare of those present in the licensed area.
